Claim has been filed with the insurance company (other party is covered through the same company so it should hopefully make things smoother) and the adjuster is coming out to examine him sometime next week.

From the damage, it looks like the hit was more a swipe than a t-bone impact.
Yikes... that's going to be a pretty expensive repair. Door, quarter panel, bumper... airbags are $$$$ to replace.

I was driving down a street (I had the right of way) and a woman in a Mercedes ML320 came into the intersection, I tried to swerve to avoid her but it was too late and she hit me, I spun, hit a pole and came to a stop facing oncoming traffic.
it comes with 2 adapters so you can mount it in various locations in the garage if you prefer.
you just twist the whole assembly and it unlocks from the wall. pretty cool.
If I am found to be NOT at fault (which I believe is true seeing as how I had the right of way and she had a stop sign - so she would have to make sure that traffic was clear in both directions before proceeding!), then her policy would cover my bodily injury claim, correct?

and yah, i agree with CR&PW&JB...that's going to be well over $5K to fix.

Did the side curtain airbags help (i.e. actually cushion your head) ?
I always wonder about this because I ride a lot with my daughter in the car.
The reason why the driver's side window is down is because the tow truck guy lowered the window when he was parking the car at my folks' place and it basically got stuck in that position and wouldn't go back up.
The only injuries I have (so far) are bruising of the upper left arm and left scapula area, cuts and rashes on the same areas, and a sore neck and back. I was taken to the ER by paramedics after the accident so I got checked out and my head CT was negative. I'm a nursing student so I knew what I needed to have done when I got there.

Rules on handling of Bodily Injury claims also vary by state. Generally speaking though, they will owe you for your Med Bills, Lost Wages, and Pain & Suffering.
From the looks of your pictures and the description of your injuries, appears to me you have a pretty decent injury claim ahead of you (don't think hundreds of dollars. Don't think tens of thousands of dollars.... think thousands).
Ps. Your tow truck driver wasn't too bright. Rolling the window down with that kind of damage to the door ?? Now you have to make sure the vehicle is under cover or put plastic over it. What a dummy.

Holds my two 5-gal buckets, my wheel and wheel well brushes, and my bottle of Wheel Cleaner. Only bad thing is, the bottle doesn't fit in the cubby. Looking for a good, smaller spray battle that will sit in there.
And hey, the best thing is... the black and red goes with my MINIs.

I'm not planning on trying to get the most $$ that I can out of this woman. I'm a student so I'm not employed. I had to pay 6x my normal insurance co-pay for my ER visit so I would obviously want that taken care of. Other than the bruising and the cuts (which have begun to heal), I am doing okay. I wake up every morning in denial about the whole thing but at the same time I'm glad that I can still walk, talk, think, hear, see, smell, eat, poo, and pee.
No... I'm saying you have a legitimate injury claim. You were hurt, you have legit med costs, and you are experiencing pain.

If you knew anything about what I do and how I get irritated with people jacking up their med costs to get bigger injury claims settlements, you'd know the last thing I was trying to imply was for you to get the most you could out of your claim against her insurance policy.

Like I said earlier, I'm at the point where I just want my MINI fixed. Thanks for all your advice though. I'm sure it'll come in handy when the other party's claims adjustor calls me next week.
Don't take any settlement offer when they do call you.
1. Make sure you wait long enough to know you won't have any future problems. Neck and back injuries can be tricky. Give it at least a couple of months before you settle the claim.
