Over Revved and Under Timed? Advice Sought

the dealer is now claiming my car is over revved and under timed. And that the transmission is abused...

I have an automatic transmission, and the car has 16xxx miles on it.

And the engine is fried. Nothing crazy was done in the car, lol.. and they want me to buy a 11k engine, or however much it costs after labor...

Which is very upsetting.

Thoughts?

Sounds like they are trying to get out of claiming under warranty (who knows why).. My brother killed his R50 Cooper engine by driving through a deep water ford and MINI happily replaced it under warranty - can't imagine they have any case saying that you've over revved it. Maybe you should go to a different dealership and see what they say..

your dealer is bs. unless you're a REALLY crummy driver, they have no excuse. call mini. or go to another dealer like the minimegb said. or move out of florida.

It's not possible to over-rev the auto. Even if you put it in "full manual", when you rev up above 6,000 rpm it'll automatically shift gears - it's not even possible to get it to rev to the theoretical rev limit.

I re-read your original posting. Wow...slim chance of the service department getting 5's on the survey. I'd consider adding the BBB to your call list along with Mini USA.

Call and ask to speak to the General Manager of the dealership. He may want to keep you happy.

My plan is to let them work on getting it fixed and this mysterious 200 dollar authorization I let them have to diagnose the problem.

And then at the end, if they still refuse to warranty the car, I'll try calling MINI USA, speaking to the GM of my dealership, and in the absolute end. Sue. Over violation of warranty contract.

I agree. I would also make things absolutely clear that you are not paying for the new motor. If they still refuse, then you start legal action. I would be very uneasy at the prospect of having someone complete a service then dealing with the warranty dispute afterwards.

I've already said I wasn't paying for an engine. I want to see what they wanted 200 bucks for ... they say for full diagnosis.

I wouldn't pay for a "diagnosis" under the warranty period. Sounds fishy to me.

I did. But you can choose not to believe it, that is your prerogative.

Oh the whole reason.. denying warranty repair by claiming abuse via over revving the engine.

Ask them to explain how you could possibly over-rev the auto! Take a video camera

My suggestion is try a different dealer if there is one nearby. It may be a pain but you may have better luck.

I believe the OBC is supposed to record evidence of over-reving. Ask them to produce it.

In neutral, but the limiter should prevent it in the first place even if someone was stupid enough to try it.

Well the dealership called tuesday (today) and said the engine was in pieces.

My service advisor decided to go to clubman training in vegas,, and won't be back until sunday. which is slightly aggravating.

The BMW fast lane advisor will handle all of MINI service requests while he's gone... lol.
