R50/53 My MINI got rear ended >:(

I got rear ended just a while ago I was driving down Alicia parkway from Target in the far right lane. I looked in my rear view and heard a crunch and saw a car quickly coming up on me than smack it happened I got hit Beepers is now tainted goods, and I am going to take her down to the local MINI dealer in Irvine tomorrow to get an estimate on the damage. I want her back to normal!!!!!!!
Damn people and their lousy driving here in SoCal

I feel your pain. I had the same thing happen to me.
Rear ended by the designated driver!!! Someone forgot
to tell them when you pick a designated driver don't pick
the stupid guy!! "Gee.....I didn' t think you'd stop."

Sorry to hear bout your misfortune.
Glad you are ok, and Beepers will be good as new in no time.... I'm sure :smile:
Have driven in SoCal myself years back......I'm sure things have not gotten better with time.
People just don't pay attention while driving.....I just plain sucks.

The dreaded rear-end collision!! I'm scared about that happening to us when we get our MINI this week. People are so aggressive in their driving habits here in Minneapolis, and the MINI is so small.....
Hope your Cooper is back to pristine condition again soon!

We were involved in one of those scenerios several years back. We were the third car in a four car crunch. A lady in her late 70's ( with a mid-80's vintage Buick) slammed into the car behind us while we were waiting at a stoplight in Duluth. We got pounded and sent into the car in front of us. We suffered only a sprung bumper cover ( all the smaller car bumpers lined up...thank god). We got out and went back the elderly lady's car, which suffered a bunch of damage...she just sat there and said..."oh, I get a little dreamy now and then...".

Bah!

I'm sooo sorry. I feel your pain. I got side swiped last week. I'm still waiting for them to get the parts in to fix mine before taking her in. It's miserable driving in a damaged MINI. I can't wait until mine is back to normal. Hang in there. For my side swipe (front driver side damage over the wheel) the plastic trim was ripped off, she was dented slightly, and the paint was scratched. Also both of my front rims were scratched. My total estimate was for $1903.00

Thanx for the concern from all of you :smile:

I just got an estimate from the body shop $908.87 If I were to order parts right now it would take a week and a half to receive parts. Now I am waiting for what the insurance companies are going to do :evil:

I agree w/ 2MINIS. I wasn't at fault either. Make sure you get a rental @ their expense. I'm still waiting for parts to come in. The body shop ordered the parts first so I wouldn't have to be w/o my MINI for even longer. No sense for it to be in the shop just waiting for the parts. When they do come in I will have a rental @ the Horrible Tree Chipper's expense!!

Terribly sorry to hear of your loss. Hopefully they can repair it good as new without too much trouble.

I was rear ended just over 12 weeks ago and I was JUST called that the repairs are done. And that's from a "certified" MINI repair shop.

I offer this advice - stay on top of the repairs. Make sure everything possible is taken care of correctly. Document ALL conversations and interactions you have with the shop. Take care of yourself, as you might find yourself in a situation like mine, where the repair shop is unresponsive (they originally said 2-3 weeks on the repairs) and talking lots with lawyers and insurance experts.

And get the other insurance companies to give you a rental. That's a must.

Yes I have to agree with documentation.... get it appraised afrter the work, so you can determine your "investment" loss. Find out how much the repairs has depreciated it as opposed to regular calendar depreciation, use these numbers as a settlement tool. See a DOCTOR... if he deems you healthy and ok, GREAT now you AND they know... But if you are diagnosed with a sprain/strain/ or other problems... You now have Professional documentation. There is also a small unknow thing called "LOSS OF USE", you figure this in for the # of days you were without your vehicle. This will also get them on the ball to fix your MINI FAST!

GOOD LUCK and BE SAFE... Do NOT play Nice with people who wreck your car!

can you tell us more about "loss of use"? is this only if they don't give you a rental? or could it apply to having a car that was three weeks old getting repairs for 12 weeks (see above)?

I believe it is differant for every situation...

My Fiance had a 240sx (months short of Payoff) it was parked at the curb and was slammed into in the middle of the night by some idiot..

I immediatly knew it was totalled, I had a 240prior to that and was involved in a near head on, so I knew the parts and labor costs... so I deemed it totaled, told the guy, and his insurance that night...and bought her a car the next day. They took her wrecked 240sx away for 3 weeks to inspect it...My Fiance's insurance inspected it and totalled it. The amounts were listed to market value..they dilly dallied another 3 weeks before coming to a decision... 5 other parked cars were also involved, but not totalled. So they told us they need to contact the owners of the other cars and that their driver claimed his brakes failed... which was BS since the cops at the scene checked them and mocked his claims.
So that set it back another 2 weeks.

8 weeks AFTER the wreck, they decided to pay the claim...
but it was not the amount we were looking for.
So an attorney advised us to threaten the INS co with threats warning them we would call the Dept Of Insurance. In Our case, we did not get a rental, so we related the loss of use to $50 per day... which is more than a rental provided by an INS Co anyway... $50 times 60 Days helped offset the loss of use.

When you recieve a rental from the INS Co, you are required to insure it and that costs you extra money you are already paying on a car that you have, in the shop, being repaired.... so offset that cost and charge it to the INS CO.

I hope this helped a bit.

The deal is, you should NOT have to PAY to be put in a rental or whatnot while the car YOU own is being repaired due to THEIR insured driver.

I'm very sorry to hear that! I know exactly where you were hit...I live in RSM...and that stretch of road is quite nutty. I had the very same thing happen to me a few years back. Start a paper trail and fight for what you deserve! That person owes you a bumper! Make 'em pay!

Thanx for the advice guys! I was already planning on getting my car appraised to see what the diminished value is after repairs I went to the doctor and I have lack of reflexes in my left arm, the Dr. said this is probably due to the nerves getting sprained and he gave me a script to get my cervical spine x-rayed as well to make sure that nothing in the spine is damaged. AAA my insurance is really helping me out getting a rental car, and getting the repairs done. The body shop I choose was Spectrum Collision they are a BMW factory certified repair shop, when I got my estimate done I noticed their were a few other MINI's there as well They also told me it will be a week to get the parts...err

BTW- do I go through my insurance to get an appraisal on diminished value so they can go after the other insurance companies for my loss?
