Sorry to hear this happened to you. Whichever insurance company you file through, keep in mind that if it is totalled, you do not need to take the first offer they make. Make sure they include all options your car has when they do their calculations. Most insurance companies use an outside company like CCC to value total losses. You can (and should) request to see that report. Check it carefully; you'd be surprised how many errors and missing options you might find. Do your research and price out comparable cars in your region. Show them the research and make a case for a fair settlement. Depending on the state, they must also include sales tax value on the settlement amount as well as (in some state) registration and other fees. Good luck to you!
If he was doing 55 mph, then from the pics I have to deduce that the other guy swiped you across the front bumper. The damage doesn't appear to go very deep into the engine compartment. From what I can see, the MINI looks quite repairable and I'd be very surprised if they totaled it.

If there were no independent witnesses, I'm not suprised the officer did not find either driver to be at fault. Both insurance companies might also find this to be a "word versus word" claim and both will deny the other driver's claim.
If that is the outcome, you will be out your Collision deductible but you won't be considered by your own insurance carrier to be at fault.
This is just one of many examples why I reduced my own Collision deductible from $1000 to $500. Too many times claims turn out to be word versus word.
