will 2004 16in. rims fit a 2009???
Depends on the wheel and the car
If the 2009 is an MCS only certain 16 in wheels work because the others won't clear the bigger front brakes on the R56. The X-lites (R84) won't fit - I've actually checked that. The R90's, the R92's and R102's should fit. There was an announcement on "Motoring Files" about which wheels would fit when the JCW Brake kit came out for the R53. Those are the same brakes on the R56.
As for Jarad's comment about the bolt size - it's true, but that can be worked around. Texas Speedwerks sells a stud kit which threads into the 14 mm holes in the axel but has 12 mm studs to slide the wheel over. Or you could just take them to a machine shop and drill them out. The 60 degree chamfer in the bolt holes is what holds the wheels on, not shaft friction. I drilled some out with a 9/16ths bit and they worked fine.

Stud conversion is not required for OEM wheels (but may be for after market wheels). See the mini2.com faq on this question. It has a table for fitment and the following:
On July 12, 2006 the size of wheel bolts was changed from M12x1.5 to M14x1.25. There exists a misconception that this change in wheel bolt size precludes fitting early OEM wheels on later model cars. This is simply not true as all OEM wheels have holes large enough for either size wheel bolt.

per the above discussion and the Mini2 faq then; the larger 14 mm holes in factory 2nd gen wheels will fit correctly on a 1st Gen 12Mm car. i.e. no bushing needed, as stud is 12mm in a 14mm hole?
Is this as the seat (cone) and face of wheel is taking the load, not the bolt holes?
still curious even though the faq does list as a correct fit.

The ones that I tried fit properly -- including the 14mm studs, but the TPMS transmitter used in the Gen II cars needs a wider and flatter mounting surface than the one available on the Gen I cars. I only tried one wheel type but I would presume that the valve seat area is similar. If you are not concerned with a little yellow triangle on the instrument cluster, there should be no problem.

Makes sense on fitting and brakes should be fine, as nothing special.
No TPM on these wheels (yes, I spent last winter with yellow light on my Clubman binnacle)
And 04's did have TPM's as they ran Run Flats?. Forgot about that.

'04s did have a TPMS system, but it didn't use sensors in the wheel - it just used differences in the wheel speeds to detect low pressure. If one wheel was turning significantly faster than its partner on the other side of the car, it was assumed that the faster tire was losing pressure.
