Any answers on specific recalls for early R56S'

I have a 2008 S with just under 79k miles. I bought it used about a year ago. About 3-4 months I had a couple issues pop up. I have an issue where when I give it full throttle for longer than about 4-5 seconds, it goes into limp mode. Under normal driving conditions nothing happens and it drives perfectly fine. I also have a P0420 check engine code. I don't know if the issues are related, but I figured it'd be worth adding.

I've changed both O2 sensors, changed the downpipe gasket, and I've also inspected the diverter valve and it's in good shape. I've even unplugged it and verified the electronics were working.

I've check for open recalls and things, but there is nothing open for my VIN. There also seems to be no previous work history for anything. This car was built in January of 2008 so doesn't that put it right in the territory of the timing chain issues as well? I feel like there should be more information readily available for instances like this.

I would take it to Mini to ask, but the closest dealership is about 2 hours away. I do have a BMW near me, but they've told me they don't touch Mini's. Can anyone guide me in the right direction with anything? I've seen other talking about the warranty being upped to 100k miles, but I can't pinpoint exactly what models that happened to.

live in California and my annual smog check is coming up. Sadly with the engine light on it will not pass causing my registration to be invalid. I'm trying to figure all this out and some guidance would be awesome.

Suggest buying a scanning tool. Then you will have some good information to act upon.

You'll find that Mini doesn't like the word "Recall". They'll call it a performance/service enhancement or it'll be covered by a TSB. Sometimes you will have to show the dealer proof of a TSB because sometimes it seems they're not issued to all dealers. The only time they'll issue a recall is if the NTSB forces them too. Usually only for safety items.
