got mine too. It clearly says my 2010 is included, even though the same document in several places shows the through-2009 range.

I received the letter to for my 2010 Mini Cooper S (hardtop). It was suggested I call MINI USA (1 866 ASK MINI (866 275 6464)) and my Mini was not part of the recall notice.

But what happens if my timing belt does go bad? I think I may call them back and ask them this question.

My 2009 S Clubman uses about a quart of oil every 800 miles. My dealer has told me this is in acceptable range of consumption. BAD DESIGN. I concur that you need to check your oil OFTEN and add oil OFTEN to keep the chain fully lubricated.

I also have a copy of the letter I sent to object to the stipulated Class Settlement if anyone wants to see a copy. In short, I strongly objected to the useless 7 yr/100000 mile extension because just about every car in the class is now (mine) or will be excluded by the time the deal is inked, which many not be for a while . . . . . . as we know often happens with legal doings.

Well, looks like the fairness hearing already got pushed back two months, from May 9th to July 14th. Not sure if that affects any possible payments or not.

Anyway, got my settlement letter on Monday night. Finished getting everything I need together tonight and we'll see what happens.

Not possible, Mini has the problem fixed and only affects earlier models

My daughters 09 Clubman S engine just bought the farm yesterday due to a timing chain failure. It only had 77,000 miles with the extended warranty just going out at 75,000. Looks like I'm out around $4000 for a used engine. I just downloaded the form for reimbursement now let the fun begin...

Never heard of it on the CM being an issue with the N18. Its mostly Early N14 engines.

Prerequisites in Filing a Claim?

Aside from sending/including receipts at point of sales such as TC repairs, oil changes and anything roadworthy-related items to preserve the integrity of car... I wonder is MINI will decline claims from owners who have mildly to heavily modded their cars?

My 2007 MCS had timing chain rattle when I bought it used a few months back. I contacted Mini, and it turned out mine hadn't had recall actions on the chain, tensioner and heat shields. They replaced the whole lot free of charge.

There's probably only a small percentage of cars which haven't had the fix already, but if you have rattle then I'd recommend people checking your VIN with the dealership in case you can get it fixed free also.

I got a check from Mini today for the timing chain recall, $1689.00. I have an 08' with 91,000 miles on it. I didn't think I would get anything. I had the local Mini dealer do the chain and tensioner before I did the recall paperwork, hoping I would get reimbursed.

Congratulations, glad to hear you got the payment! Waiting to hear from Mini myself but I had my timing chain replaced by an independent shop.

**Update** Check was in today's mail(11/5/2016). Doesn't seem to matter if work was done at Mini dealer or Independent shop.

Hi Guys. I'm glad I found this thread. It's been at least 2 years since I heard about this case but I'm glad it's actually making progress.

I'm not the original owner of the car. I bought my 08 R56 S in 2013. I have the rattle but no catastrophic failure yet.

Is there any hope for me?

*Edit* Just read the settlement info. I never received a letter(probably because I'm not the orig. owner) and the deadline to file is long over. So has there been a confirmed extended warranty that would benefit us or is it useless for 07/08 owners?

Yeah, that's what I was afraid of =[. I hope many of you were able to get some kind of compensation though.

I just had some major maintenance done yesterday but was highly considering trading it in before getting the work done. Hopefully I'll be able to drive it for another 2 years without any major issues. lol

I will add my story since its applicable. I have a 2010 S Clubman I bought as a CPO (that extended the warranty till a certain amount of months or 100k whichever came first).

I took my car in before the warranty went out and told them of the issue, they said 'oh, just let it warm up it will be ok'..then after researching a falling window issue I then learned about the timing chain issue. I then took it back to the dealer and I was just outside the warranty by a few weeks. At first, Mini said no, and wanted to charge me the full boat for the repair. After negotating with the service manager, we had it down to around $430 bucks. Then the next day, I get a call from the service manager telling me that the regional mini folks were in town and 'took care of it' and replaced it.

Then, the following week, oddly I receive the papers on the class action lawsuit...

Happily fixed now and I still keep an eye on the oil level every other tank of gas.

ok, I know this is an old thread but thought I would ask your opinions. My wife's 2010 Mini Cooper hard top (non s) had the check engine light come on. I took it to the dealer and they said the codes came back as "vanos and timing chain). The pulled off the valve cover and determined that the timing chain is stretched and the vanos gear is bad. They want $3K to fix everything. I was shocked to say the least as to how a car with 50K miles on it has a bad timing chain. I went home and looked things up and of course now have found out about all of the "timing chain problems". I called the dealer and they said that my car was not included in the recall and I was out of luck. I called mini and opened up a complaint with hopes of them possibly covering something ( I know this is a long shot at best). It's only been a couple of days and have not heard back from them yet. My question is has anyone had any luck getting Mini to help cover the cost on this if their car was not part of the recall or class action???? Any thoughts or ideas would be greatly appreciated. Thanks.
