I appreciate the diversity of responses. I posted more in the spirit of raising awareness--if one other MINI owner avoids a burn, then this thread was worth it. Do I think this is a design issue, yes, I do. Why? Because this is the only car I've ever owned (nearly 20 over the years) where anybody has had this problem. Then with the MCS it happens to three different people in 9 months.
I'm going to get under the MCS this weekend and see if there is an easy way to shorten the exhaust a little. If I have any worthwhile findings, I'll post them here.

I read this thread and went outside to see if I could even touch the exhaust w/my leg. I do have a Miltek, but when I tried, my leg doesn't get close. Perhaps if I had a stock exhaust it may. I am 6"1', maybe my height has something to do with it.
