CMS '14 features missed out by the dealer after ordering.

Hello Everyone.
I have a big problem and need some advice. Ordered a new MINI CM 2014 2 months ago and I made sure to get these features added

comfort access
backing sensors
Adaptive light control
bluetooth harman system


The dealer forgot to add these options. I only communicated via email and phone after our first encounter and I told them about adding these but they must have forgotten to do so or misunderstood me, or something...

The mini is at the dock accordng to the dealer and i just realized about these features not being inlucluded when I finally asked for the final breakdown pricing of the car... I did not see those feat or packages added aside from just the sport package.

I asked for the breakdown before (would have known thrn they would have neglected to add those features) but they kept telling me to wait till they finalize with sales and until the car is here which took many weeks, so It never daunt me that these things were missed out..

Is there still hope to have them add these before it is delivered to me?
or is it too late?
So dismayed that this happened considering these options are what I am really excited to have. I cannot see myself enjoying without these , but what can I do.. it is in the US already... waiting for me to pick it up..

You need to go talk to the dealer and see what can be done in these. Your CM will have Bluetooth though. All Minis do now.

I dont think you can add these features after the build. If you can, I would love to know how because I would love to add comfort access and backing sensors to mine.

It's way too late to add those options now. The only thing you can do is refuse to accept delivery and place another order. Not an easy course of action, but it's the only way to get the car you really want.

If you communicated that you wanted those options by both phone and email (did they respond to the email?), then it's their fault. Don't let them guilt you into accepting a car that they screwed up on. Don't be a jerk about it or anything, either, but let them know you want to place a correct order.

Yeah, but at the same time, when where those mods conveyed? If too far in the build process, then the dealer cannot do anything about it. Heck, the car could have been at the dock by then.

I did one mod after I signed the paper confirming my options, but it was the JCW Instrument cluster which isn't done at the factory, so that was no issue for me.

OP can refuse delivery, but may lose the deposit.

Tough deal, but is why you should be very careful in the ordering process, and then very clearly communicate afterwards, best if in person. Judging by what the OP said, it is hard to see if there was effective two-way commmunication here.

My dealer/sales guy made me sign the actual Vehicle Inquiry Report which was essentially the paper used to place the custom order.

We went back and forth until I was happy and then I signed it.

I agree, the timeline of events is very important.

To the OP, if CMs are still selling well, they may be fine with you reordering. Just depends on the dealer and how quickly they're moving inventory.

The Sales Manager and I signed the completed Vehicle Inquiry Report (VIR). I paid the $1,000 deposit. Days later, I noticed an error regarding an option that needed correction. I went directly to the dealership. The Sales Manager corrected the option in the computer, printed out a new VIR with the same production info, and we signed the corrected VIR that day.

If you sent an e-mail requesting the option changes, but never received an acknowledgement, you're stuck. Whatever you signed for on the VIR is what you ordered. The duly executed VIR is your sales contract. You cannot make unilateral changes without the dealer acknowledging and agreeing to the revised order. You cannot assume they received, reviewed, and agreed to change your order simply because you issued a fax or e-mail. I don't know when you attempted to alter your order, but factory-installed options cannot be changed once the car is scheduled for production. That's my 2 cents.

Well, you don't really have to accept the vehicle. In the end, YOU are the one that has to be happy with it and paying $30k (roughly) for it. Make them order you another one with the options you want. They can keep this one as Dealer Stock.

I did it with my SM with one I ordered. Had them submit a new order, he wasn't happy about it. Tried to "talk" me into sticking with the one that I had originally ordered and was awaiting transport. I had to do what was best for me and place the new order. Only this time he had me sign my VIR with the notation that my refund was now Non-Refundable, didn't do that on the first one.

Good luck with whatever you decide to do!!!

If they ordered your first vehicle without a signed VIR and non-refundable deposit, that's the MINI dealership's problem. They did it correctly the second time, though technically you could have walked away from the deal and forfeited your $1,000 non-refundable deposit.

No matter whose fault, if I wasn't happy with the cars options, I wouldn't pay for it. When I ordered mine, one of the papers I signed was for - if I hadn't taken delivery within 30 days, the "non-refundable" deposit, was refundable. I'm in California. Check your paper work. If you don't have it, ask your MA for copies.

My deposit is only $500

If it's not what you want, don't accept it. Your the one STUCK with it in the end!!

If you're not happy without those options, don't accept delivery. Forfeit your deposit if you have to, but don't get stuck in a car you don't want.

I don't believe you have to forfeit your deposit if you say no....check state laws.

I want to thank you all for responding to my situation/problem with my Mini order. I followed your tips and advice. I have told them what I felt and they admitted their fault. I was not even given a form to sign in the beginning.

They will create a new order will all the stuff I wish to have. I have received a break down list of the specification (unlike before where all was done verbally)
