I'd say he's serious, wouldn't you? It's a fully loaded JCW with about $6k in dealer installed options, selling for retail price. Doesn't look like he marked it up either. That's a lot of car for a lot of bucks. (Some things never change.)

Yours should also have the new logo. It seems everybody who had their JCW Aero kit installed at the VDC has their door sills changed out by mistake. Talk to your MA and he should make arrangement to have them switched out. That might cause a problem for you with you being on the other side of the country though.

DP, the reason you have the old style sill plates is because the Aero kit comes with them. The factory JCW sill plates are stick-ons and have to be removed because they cover some screws (to remove the factory door sill). I guess when they peel them off, they get ruined.
I bought and installed the aero kit myself and I can see why everyone has the older style sill plates.

Mine do have the new logos, but mine has the new logos with lines going the length of the sill. The ones in this pic have checkerboard pattern going the length.

The dealers in the San Francisco bay area are adding $4-6,000 to the MSRP for the JCW cars.
I just bought one at MSRP but had to buy it out of state.
It doesn't shock me that this dealer is asking this; it would shock me if someone bought it.

Ferman MINI in FL has two JCW's on the lot that "sticker" at $42k-$43k, too.

If I were stuck...
in a big mark-up zone where I couldn't find sticker prices, I would probably order from somewhere willing to sell for sticker and use the saved money for a plane ticket and a nice drive home. (not my idea: a friend of mine bought a used one that way)

That's what I'm doing. Bought it Minneapolis (where business takes me) and driving it to California where I live. Save $4-5000 minus fuel and a few hotel nights and I get a mini vaction out of it.
I don't doubt that a MSRP could get into the low-mid 40's. Load a JCW car up with options and you are there.

What seems odd to me is that the only written part of the description says "87 PICS of 2009 JCW...."
One of the more common scams on eBay is to sell pictures of expensive items but making it look like the item itself is on auction.
I'm not saying that's what's happening here, but it is odd. Especially since the description itself is so thin.
Maybe someone who's near the dealership might check and see if they really listed the car on eBay.
Someone with no link to the dealership could have listed it as a scam.
Plus, why's it described as USED?
