What a wonderful mess!
Bought a 16,000 mile 2005 Cabrio in September 2009. Got it from CarMax no less. First the top broke twice. Plastic filled the back seat. It's been replaced twice. First the inside only and then the whole thing. The idiot lights come on when I hit a bump. Four tries have not cured it. It is still not correct but is better. Parts of the dash fell on my feet. Everything was replaced including the center stack. They also found a bent strut bar and replaced the whole front end. Several other parts have broken or fallen off. Bottom line I've driven the car for less than one month. The great news is CarMax is in for $6,000+ dollars and has taken care of everything. Yep, including three loaners. Here is the question. They have offered to let me claim the lemon law and get another car. What would you do?
Sounds like the previous owner had something happen that it's no good, I'd claim it and look into another used or a new one, think of it as having had a 3 month test drive to so you'll better be able to know what options you like and dislike.
Thought I would report back on my MINI woes. True to their word Car Max fixed everything.We had some problems getting it right the first time because they are not MINI specific mechanics. They had the car for almost two months and provided me with 3 separate rentals no less. Here is what they did.
1. New front suspension including shocks and struts.
2. New tires and one new rim.
3. New top including all braces and canvas. Upgraded to 06 specs.
4. New center stack including radio, heater and switches.
5. New glove box and drivers side lower pannel
6. New lighter and lower tray package
Everything was put right and checked for fitment. The result is a really
tight car with no rattles what so ever. It runs and drives totally different.
I still have sixty days to keep it or turn it in for a full refund. Now what?

Sounds like they built you a new car!! Drive it and make sure it works like it should!! Talk about an inconvience, 3 rentals and a few months without your car....Hope it works out for you...either way!! After all you have been through you deserve it!!
Enjoy it to the max for 60 days and tell CarMax to gift wrap it and send it to Prince William.

It sure sounds like it has been abused, to me! I am surprised there have been no issues with the drive train. That they have not replaced anything in that area after the extensive repairs everywhere else, would leave me wondering when it was going to fail as well.
