Deposit refunds -- How does it work?

I currently have an MCS on order but just wondering if maybe I should have gotten the MC instead... so if I change my mind when I see the MC would I be able to cancel and just pick another car? Any specific conditions for cancelling an order?

Although they will claim otherwise, in every state I know of, a dealer cannot keep a deposit for a cancelled order, regardless of what the contract says, unless he can show actual damages. In this case, since you are still planning to order and MINIs are not exactly hard to sell, it shouldn't be an issue anyway.

Yeah. All dealors are a little different. But the bottom line is you can get it back.

Most likely, if you express your intent to re-order another car with the same dealer, they probably won't give you much flak. Just be straight with them and get the car you really want.

Cool then, thanks. I am ordering the MCS and if by any chance (don't think so) I decide to get an MC I will just cancel that order!

It's good to have options!

Just out of curiosity, what is the reason you think you won't like the MCS? It's a blast!

if you don't intend to buy another the salesperson might be a bit pissed as I am sure he/she will lose a sure comission ... but hey ... like someone else said. the car is not hard to move off the lot

Since your MINI is not in production yet, can you just change your specs from MCS to MC and still keep the production number/week.

Both the contract they gave me when I paid my deposit back in October and the purchase order that was filled out in mid-February -- had to wait for the March build since I wanted an MC with a manual transmission -- specifically said the deposit was refundable if I backed out before taking possession of the car.

I didn't know if that was standard among Mini dealers, but I appreciated how they were up-front about that and that the entire deposit would be refunded if I decided to not complete the deal.

Mine didn't even request a deposit--they took the order in December for a February delivery. My guess is they figured they could sell the car I was "designing" if I backed out.

I know, I know... I am eternally indecisive...

I am sure I will love the MCS! frankly I am a bit concerned about emissions, gas prices and what might happen in the next few years w/global warming so in that sense the cooper is better (though only marginally so..)

but I also can't really truly enjoy myself w/o a car so I just want one that I can enjoy on weekends... or (knock on wood) in case of emergency. the car won't be used that much

So: MCS = fun / MC = more sensible choice

In various talks with my MA (my MCS should be in Port Hueneme 3/29!) he says that orders in worldwide will have a car ordered now delivered to a USA buyer in SEPTEMBER. That's a long Summer riding your bike and dreaming Mini dreams. I say relax, go with your MCS order as it stands.

that is not true... dealers still have slots. I placed my order last week for production next week --car should be here mid to end April. another dealership offered a May delivery.

I ended up testing an MC automatic... I was revving the engine like crazy! I am actually a much calmer driver on the MCS believe it or not...

hehe, I am half Hungarian as well. been in the US over 20 years.

RE: the MC vs. MCS ... do not underestimate the MC for hauling *** ... not sure about the new gen, but the R53 MC is a blast to drive ... many a MCS driver will confess to this. They are even known to kick MCS butt in auto-x

hungarians have moved around a lot, haven't they I've been here 15 years myself.

I don't underestimate the MC... I think it's a great car and the new one seems more spirited than the old one. In comparison to the MCS it just felt like I had to keep switching gears to keep the engine from revving too high.. ha, ha... it was noisier than the MCS! dunno, why it could have been because it was an auto and I was using the paddle shifters or just the way the engine is tuned...

btw, I hated those shifty things... how ackward! I'll take a clutch any day...
