R52 Gouges in convertible top

Gouges in convertible top

I am wondering if anyone has experienced what I have with the top on their MINI. On each side of the roof, towards the edge just above the windows there is a rubber strip. The strip is sewn into the roof and runs from about half way across the front window and over the rear. (I should take a picture but my camera is currently broken-best I can do it an old picture pointing to the damage location).
Anyway, the one on passeneger side of the car has gouges out of the rubber, like something is pinching it when the top is put down. My MINI just spent a week and a half at the dealership for various issues and when I picked up the car I was told that only a BMW rep can authorize a replacement top for these gouges (I also complained about roof wear-for which the roof has already been replaced once). So I have to go back to the dealership sometime this month when the BMW rep comes out. I was a little disheartened that although they couldn't replace the top, the service department did nothing to determine the cause of these gouges, so they are just going to keep getting worse.
Anyone else have this rubber on their top damaged?

Just checked mine, looks fine, but it's only 5 months old so far.
