Because it's an '04 JCW, those were the 200HP rated cars, that were delivered stock and had the JCW kit installed by the dealer, the original owner probably just missed the 5 to 6 speed switch, esp if it was built in late '3 as an '04.

Of course. People swap the early 5 speed Midlands in their R50s to the later 6 speed Getrags because the Midlands is famously fragile and has a tendency to grenade itself when faced with the whopping 115 hp of the base model.
Are youu sure someone hasn't added second hand jcw 'trim' to a standard engine? As said r53 didn't have the 5speed. Unless the car has been raced a lot as I have heard the midlands is far better for fast/hard driving, but weak inside. All you really need to do if you have the 6speed in yours already is swap the engines out (change clutch and inner cv joint seals and crank seal behind flywheel)

Thats seems like the most likely reason for the 5spd if indeed it is a 5spd . That leads me to another question . If they went to that extreme and swapped out the 6 for the 5spd then they probably changed the cam and probably have a custom tune as well .who know what else
Quick vin check says 6spd trans so if it has a 5spd it was changed . I'm not sure what to think regarding other engine mods. If there's a bigger cam etc.
The pic resolution is bad, but from some of the parts and the large outmotoring decal, that car looks like it belonged to someone that was really into MINI’s
That looks like a factory JCW carbon spoiler, possible Team Dynamics wheels, bigger brakes (possibly JCW’s), possible JCW carbon hood scoop, hatch handle, and super rare mirror caps. It also looks like the front and rear JCW badges are still there. Lots of $$$ stuff if you can pull them yourself. If not, I don’t know/doubt if they would be careful enough to pull the stuff off without damaging them.
Thanks for the info . It's a bit of a drive but doable . I'm having the engine shipped because the gas would cost almost as much as the shipping. I will ask about the parts you mentioned tomorrow.

I just spoke to rhe yard . There sending me the SC, TB ,BPV,and the intake manifold / injectors . They're going to check compression when the engine is out and call me .
There was no Factory LSD option available from MINI before the MY ‘05 facelift. Research the codes to make sure, but I think the LSD gear boxes have the code BKL and the regular ones are BKD. Then I would check with the yard to see what gearbox they have before purchasing.

Bad news . They said cylinder 1 and 2 compression readings are 60 and 90
could be rust build up on the valves & seats......my '06 JCW motor I got from wrecking yard had low compression in one cylinder, I was about to call the yard back when I decided to put some oil in the cylinder and keep doing the compression test on the back of my truck tail gate.....every time I ran another compression test, the numbers keep coming up......once they were all equal around the 160psi range, I decided the engine was a good one. I also had a mechanical oil pressure gauge installed and had 25lbs at cranking speed
