Scary. Period. It has such enormous potential for "big brother" written all over it... and not the good kind (i.e. CBS).
I really hope they pass laws that require vehicle owner's consent to access any data recorded by the EDR. It's your vehicle, and you should own everything on it, including the data.

i think they will need LOTS of data storage to be able to
hand out tickets by GPS data... but i think it's possible.

Looks like some 2005+ cars already have them on the car and you don't know it

I would imagine here is the counterargument.
The ECUs in new Porsches and Lotus record a great amount of data on the engine. For example, how many seconds the engine was turning such and such RPMs. What was the highest operating temperature, etc. They even record how many times you dump the clutch at high RPMs. Who owns that data?
On the first service of an Elise, they pull the ECU dump. You abuse the engine during the break-in period, its ground for denying warranty coverage. You exceed the redline, to much, too high up ... no coverage. I could imagine that you can say NO, its my data ... you cannot look at it but Lotus then says, OK, no coverage.
I would bet insurance companies do the exact same thing. You deny them access to the data ... fine ... no coverage.
The more I read into this, the more I do not like it. Accessing engine information ... how fast I was going, how long, etc. is one thing ... knowing EXACTLY where I went via GPS ... thats crosses the line. Whats going to be next? Private investigators pull the data and tell the wife "Heres the address hubby has been spending his nights at?"

There is no reason why they need to place a black box on ANYone's car. Whats next? Monitors inside your home? Did anyone see "Island"? The guy gets up in the morning, urinates in the toilet, and the toilet runs a UA and tells the guy if anything chemical is "off" in his system. It still worries me that the courts will decide who sees the data collected. Here's my paranoid scinario...Did a track day & then a couple of miles down the road you are involved in a wreck that's not your fault.. They look at the data logger & it shows you drove over 110 miles per hour for most of twenty minutes. The prosecutors may well say you drove like a maniac & caused the wreck. Maybe a bit far fetched, but maybe not so in the near future.
