So I have a set of 12mm spacers with (what I think are) 40mm bolts. I am thinking of going to 10mm spacers. Can I use the same bolts, or do I need to find 38mm bolts? (stock is 28mm I think?)

No. You're using less of the studs so you're fine.

An extra 2mm isn't going to do any harm.
