JCW 09 Jcw
Easy
Get the VIN # & have a mini dealer check it out.
A factory 2009 JCW has red Brembo calipers and large non-drilled vented rotors, The gear shift **** has a black insert with red lettering.
Challenger 17 inch wheels, Larger sway bars.
A whole lot of stuff you can't see but you sure will feel the power when you drive it.
The VIN number is the best way to see if it is a genuine factory JCW because they do still sell the dealer installed JCW kit.

In addition to the subtle trim differences (although I'm pretty sure the factory JCW vehicles did not have the engraved tailpipes -- at least my Clubbie doesn't...), you can verify it yourself using the VIN, as "ronnie948" suggested. See this post I made to another thread; the second paragraph explains what to look for in the VIN of a 2009 factory JCW Clubman.

I was wrong on the engraved tailpipe info.
The exhaust tips are not engraved. I guess I read it did someplace and never checked mine. The tips are different then the "S" tips though. I just went out to the garage to see mine and they are smooth as a baby's butt. They sure sound good though.
Get the VIN # and if your nearby dealer won't help you then ask your insurance agent.

WMWMF9 for the first six numbers
From what I have read here on this forum the first six #'s are WMWMF9
It seems that the "9" tells you it is a factory JCW from 2009 up until 2011
Big Gripper has the information in the JCW Forums on NAM
I check my # and it does have the "9" as the sixth number from the left ( First actual number)

Ya better hurry
I don't know about other dealers but the 2009 up factory JCW any type don't last long at my dealers. Get there and check it out and if it is in good enough condition for you then make the deal.

Yup, that's a factory JCW. Here's a web page that offers a bit more comprehensive decoding of the MINI's VIN. Digits 4-7 of an '09 JCW factory Hardtop (US market) should be "MF93". The model year code ("9" in the case of a 2009 model year vehicle) is actually digit 10...
Thus, the initial 7 digits (again, US market) of an '09 factory JCW Hardtop should be "WMWMF93..."; for an '09 factory JCW Clubman, it should be "WMWMM93..."; and for an '09 factory JCW Convertible, it should be "WMWMS93..."
