Please help need advice!!!

I own a 2013 pepper white jcw with 5000km fully loaded.the car has been at dealer for 7 weeks with an electrical issue. I have only had the car for 6 months. Well they can't fix it, bottom line even the engineers at the top can't figure it out. With out getting into major details about what has gone on. They want to replace the car but they don't have any 2013 jcw anymore. They won't release the 2015 jcw until dec ish. So they want to give me a 2014 fully loaded cooper s . They will wipe out my current loan and start a new one.my payments will cheaper as the new car is cheaper. i have never been in or seen the new 2014 .i love my JCW .so what do i do.any thoughts would be great. Cheers

Seems easy to figure out:


1. Take the deal.
2. Wait until December.
3. Walk away and buy a Focus or a GTI. Or maybe a pre-owned, off-lease Cayman.

If finding another 2013 pre-owned isn't option, Get the best possible replacement you can out of them and tell them you want trade up when the new ones come in. Surely they'll be nice enough to call you the minute they become available for your trouble. I'd hope.

Well i purchased my car back in oct and after 1 month my battery was dead,so i brought it to the dealer ship and they replaced there battery and couldn't figure out why it was dead. At this point i have taken countless hrs away from work and spent hrs in phone calls to mini Canada and dealership with no luck So after some meetings and some arguments they are finally going to replace the car ..there is more to this story but i'm so done with this whole ordeal..... But of course they don't have any 2013 JCW and they want to give me a new 2014 cooper S. waiting for the new JCW is not an option. WELL U ASKED FOR IT SO THERE IS THE LONG AND SHORT OF IT

Is there a reason that MINI Canada now being involved can not get a 2013 JCW from another dealer across Canada?
And IF they say there are none......maybe try the USA?

Or how about this.......let them take the car back, wipe out the loan, pay you the down payment back and all cash you may have given.....and walk away!
I say this as a possible motivating rouse to them to maybe step up and do you better!
If not, take your money, and shop for a new MINI again on your own terms and time.
You may need a ride or transportation, get a friend or short term rental, and get what you want, nit what they want.

Just my opinion.

I believe it's pretty clear that you want and should ditch the lemon '13 JCW.
Did you buy or lease it?

If you leased, then terminating lease early and walking away is a reasonable outcome (assuming you put 0 down).
If you bought it (you mentioned a loan), you have been paying off the 5 or 6-year loan at a rate far greater than the lease, and have some equity in the car. On the other hand, R56s have been dropping in value like rocks since 3rg gen F56 came out, so your equity may minimal or negative!

Check your state's lemon laws, and make sure to get the maximum possible settlement for the car. Dealer's offer may or may NOT be a good deal.
Insist on settling on the JCW first, and THEN negotiating a deal on a replacement. Otherwise, they will hose you on the second leg of the transaction (F56 purchase price, options, etc).

The next question is with what to replace your lemon.
Step 1 - test drive F56 and see how you like it. It is a much more refined and upscale car with all around improved interior, suspension, and torque from the 2.0L BMW turbo.
Step 2 - drive everything else you like, and don't feel obligated to buy another car from MINI, or from that particular dealer. Remember, it's lemon law protection that got you out of your lemon '13 JCW, not dealer's good will!!!
- I would personally explore an 228i and M235i's, as they offer much more bang for the buck at the prices equivalent to Cooper S and JCW.

Well, here is a thought.

They may not have the new MINI JCW in production but surely they have one on some lot somewhere in NA. So I would have either you or them look at MINI new car inventory in whole NA and find the closest JCW to you spec OR up! (meaning for everything they can't get they should offer you something in exchange)
And I would have them import it to your destination free of charge.
How hard can that be?... maybe you could also look at GP inventory!

I happened to be browsing the inventory of the Florida dealers today and Braman MINI in Miami has two 2013 JCW Hardtops and five 2013 JCW Coupes. I know this about as far from you as possible but it looks like there should be 2013 JCWs to be found.
