So I was rear ended in the middle of August. The body shop fixed everything and when I got my car back I needed the alignment done again because it wasn't correct. Steering wheel was still crooked. I took it back and they had to order a part and it's still not in as of today.. I have been driving the car because the Insurance Company stopped paying for a rental. Noticed this weekend the rear tires are bald.
Do I have a case to have these tires replaced? I believe that either the Body Shop or Insurance should pay for this because they were in very good shape before the accident and now they're trashed due to the alignment being off and not taken care of at a reasonable time frame.

Does not sound like the alignment was done.
Call the insurance adjuster, take pics of the abnormal tire wear, calculate the mileage travelled since the MINI was returned to you. ( The body shop's repair order has mileage in )

What part was it you need? And what were the alignment specs you current have after the first alignment?
Sounds like two things, steering wheel crooked which is a front alignment and rear tire wear. That is why I am asking about why part it is.

That's something you'll need to go back to the body shop for. If an alignment was on the estimate, then the shop should have done it. Not sure if the original estimate had suspension repairs on it. Either way, the shop is responsible to expose and repair all damages. If they find additional damages not already on the repair estimate, then they should contact insurance. Otherwise, it's all up to them to correct....your tires included.
Two different issues. OP says steering wheel was 'still crooked' - was it crooked before the accident? How many miles driven before the rear tires became bald? How much tread left previously? Even wear, or bald on the edges?

My steering wheel became crooked because the accident occured in a traffic circle, I was trying to continue to go around the circle to the left and the rear was pushed to the right. They needed the control arm according to the body shop.
The car is at the body shop now so we will see what they say.
