Tint law in IL about to change!!

Tint law in IL about to change!!

So I have been following this on another local forum for some time. It appears that 10/28 is the day. The state senate will vote on Weds and its a done deal.

Have any local Chicago people been following this? Can anyone speak with any certainty as to weather Chicagos municipal code will change? Is it connected or seperate from the state? If it was just a $25 ticket here and there I would have done it anyway. The city is passing out $250 tickets like candy though.

The law changes to allow up to 32% tint all the way around the vehicle except for the windshield. If your rears windows are tinted darker than 32% than your front windows can only be 50%.

Looks like on the 28th of Oct we need the State Senate to pass the override with 3/5th or it dies altogether and we are back at sq one.

I have a friend in the tint biz that worked with the IL State Police to get this law changed and he's 99% sure the Senate will get the 3/5th needed to get this deal done.

As for Chicago I don't know what if any thing the state law would change.

I've had limo on back of my cars for ten years and the fronts one shade lighter. It's only been in the last two years that I have been pulled over JUST for tint twice and I just paid the fine, $100 each time that's all they want is the cash, and left the tint on.

I hope the law changes and our fine Police Dept's can do something productive with our time and go after dangers people without tint too.

Well, at this point, until of this recent update on a possible change in the law, the only way to LEGALLY have tints on your front windows was an eye doctors note and a set of plates from the State of IL with the last 2 letters ending in TW, for Tinted Windows. I've had my BRIGHT yellow truck tinted 2 1/2% in the front and 5% double layered tint on the rear 3 windows. I have only been stopped 2 times in 2 years, until about a week ago. I've been stopped in Winnetka 3 times in a week.... Don't you have something better to do?

... Due to misspellings and incorrect vehicle information, I beat all 3!!!!

The state website says "a motion for amendatory veto has been filed" which means, I think, that someone has proposed voting on it but that the vote hasnt taken place yet. (I am not a politician or lawyer though so I am not exactly sure) This was dated 10/28/09.

The law did pass on 10/29. It is 35% that is allowed, unless the back windows are darker than that, then the front ones can only be 50%.

HOWEVER! I followed the letter of the law to a tee and recieved a $250 ticket from Chicago for tinted front windows. Its possible the officer just wasnt up to speed. Of course I am contesting the ticket. I will let everyone know the outcome.

The law "passing" and being "enacted" are two different things. When will it be enacted?

The law went into effect immediately after passing.

Im contesting the ticket. What I have been trying to find out is. Can the citys statutes over ride the state? Or are the police officers just misinformed?

I took the film off of my 2 front windows to avoid getting $175,300 in fines while the original ticket is being contested.

I guess we know how they're covering the gaps in the budget this year. All that just for tint?

I've got to say I'm happy there's not more two tone tint requirement!

Just an update.

I am contesting the ticket in person and am awaiting a court date.

After posting on a law school blog, and talking to a small suburban mayor I know, I have learned something. There is a state law called "home rule" where a municipality of a certain population or more can over ride state statutes with their own municipal ordinance. I suspect that I will be "on the hook" for the fine and that tinted windows are still illegal in the city of chicago proper.

I will post the outcome of the court appearance.

I got pulled over a few weeks back and the cop asked if the tint was factory. I told him it was not and that Quinn signed a bill that would allow 35% all around. He said that he did not hear anything about it. I told him it was fact and he could check it out. He said "Well OK if you say so" and let me go.

Alot of cops out there are not up to date on the tint law. So all you need to do is bring that document to court and fight that ticket. Should get dropped. Sure its a waste of time. And i think they should make it mandatory for all police departments to be well aware of new laws

I just printed the web page that I linked in my previous post, put it in my glove compartment, that way when I get pulled over again I don't have to go to court over something that is already legal.

Update: Still waiting for hearing. Ticket still shows up on city website.

Also, ABC 7 is doing a story on window tinting and the law sometime very soon, maybe today. A friend texted me Rozz Varons (The woman w/ the goofy eyebrows) phone #. She is looking for people that got tickets. I have a VM in to her.

Finally!! Yesterday I got a letter from the city that they were dismissing the ticket. They didnt even give me a court date. It only took 4 months!

Just a heads up ... State Law says 30% tint is allowed on all windows but the windshield. If the rear windows of the vehicle are tinted darker than 30%, the front windows are only allowed to be tinted 50%. Most police will not bother you for the tint any longer, unless you happened to get stop for another offense, ie speeding!!
