Wheel fitment

Hello. I need some help. I found these wheels for sale locally and what to get your opinion on whether they will fit on my 08 R52 JCW. The guy said he had them on his 2011 mini. They are 17x7 OZ racing ultralegerrawheels. He said they are a 40 setback but when I look them up online I can only find them in a 38 setback. He's asking 500 for the wheels and center cap . No tps sensors, lugs, or tires. No curb rash. Thanks for the help.

I would but they aren't that nice up close. One has bad curb rash. And places I checked with dont want to work on 2 piece wheels to fix them.
