how many miles on the car?
the first and for most thing you want to do is check the ATF level.

I just replaced the automatic in my daughters 08 "S" because it was taking a deep breathe (slipping through) between 3rd and 4th gear. I think that it was a valve body problem and it was cheaper for a used trans than a new valve body
Besides checking the fluid level and scanning for faults, I would try changing the fluid if you can do it yourself. Dirty or old fluid can be really bad for these cars, but if you're lucky a fluid change will clear up your issues.
How many miles on the car and do you know if the trans has ever been serviced, or if the fluid has ever been changed?
Luckily you have a 2nd gen so you'll be able to monitor the trans fluid temp to make sure it's in the correct range when checking the level.

The amount with out dropping the pan and changing the filter is somewhere between 2-3 quarts. People usually do 3 changes with a short drive between each change and you should end up with a little over 80% new fluid. There’s a great YouTube video for the Aisin in the VW which is essentially the same trans, and another with a MINI, I think from a shop in England.
In the meantime, you should go through this giant thread: https://www.northamericanmotoring.co...ed-at-80k.html
Even though it’s in the 1st gen section, most of the info still applies to your trans.
JWS3309 spec fluid is what you want and many people go to the Toyota dealer to get it. It’s cheaper and I think Aisin is owned by Toyota. If you go with synthetic, I don’t think any is actually JWS3309 spec, but are advertised as compatible. People who go with synthetic don’t seem to have any issues, but I don’t know what your preferences are when following manufacturers recommendations.

Here's a long video on changing the fluid on a 1st gen:
Here's some info on how to check the fluid level. The temp of the fluid is really important and is explained around 1:40. Luckily you have an R56 so you should be able to get the trans temp reading using a diagnostic tool hooked up to the OBD 2 port.
Here's some info on the valve body and various adjustments you can make to correct shifting problems as long as the valve body isn't damaged or worn out.
