05 MCSa transmission problem
Your notes are partially incorrect, all the Getrags were 6 speeds, only the Midlands used in the early R50's were 5 speeds.

yea 05 does have the gertrag tranny, and i think 06's is the same, just pain in the *** and way too much money

Remember, we're talking the auto transmission, not the manual. (And the CVT in the R50 is another beast altogether....)
im aware of that i own the 6spd auto and asked the mechanic whether it was the gertrag, and not sure whether its the design flaw of parts inside wearing out or what, but its costly

If it is an MCSa - an automatic - then it's an Aisin. Not a gertrag.
And I highly doubt any dealer did a fluid change in it. it's not a factory recommended service, and it's difficult.
Before I did ANYTHING else, I would have someone ACTUALLY do a fluid change - with three drain/fill cycles, then see if that resolves the issues. If not, you're not out much. But fluid changes can make a radical difference in how these transmissions perform. I did mine at 80k and it was like a new transmission. I just finished changing the fluid for a friend on this Clubman today.

yea i understand its not recommended, although when i bought the car the person told me the tranny was serviced at 30k and i called the dealer where it was serviced they said yea they did the service, but like you said i cant be sure, but flush does include taking off the pan cleaning it out, changing the filter and a new gasket, and if i could find someone who would do the 3 fills and drains, i would much rather do that than replace the whole tranny

so i finally got my buddy to help me out with the drain and fill, and it took some time, everything went smooth just took a while to fill in the fluid. got out about 2.5 qt both times, i only did it twice because my buddy had go to work. first drain, the oil was very dark, brownish dirty, pretty bad and the second one was more clearer yet still dark. so far i didnt get to drive too much yet but it seemed like the car was shifting ohhh sooo smooth, i was happy, hopefully it will stay that way. gonna go drive it more in a little bit. thanks again for all the help.
