Why ME?

OK so i bought a MINI Cooper s 2007 stick like 7 months ago from a dealer here in Charlotte with 38000 miles or around that....

as i was test driving it i told the girl second gear was crunching, and i would think about it over night, so i slept on it and they test drove it and said it was nothing and they didn't feel it?(ya OK)

the used car manager came over to me and said " listen i promise you there is nothing wrong with this car if you like it buy it, Its still under warranty and if something goes wrong we will fix it"... I'm like WOW great ill buy it, after all it was my second car from them and i did love the mini...

so I'm driving it for a week and i still feel that crunch in second gear, so i brought it back to the dealer and again they test drove it and said they didn't feel it, but the clutch was releasing late so i would need a new clutch soon, they said...I'm like what ever..

7 months go buy and now I'm on my way home from Florida from Charlotte, and third gear stops working all together, my stick wouldn't even go into the gear, not to forget to mention that the time i get back to Charlotte from that 16 hour drive I'm over my limit and my warranty is over,ahhhhhh

So I'm like enough is enough and i got a second opinion from Dan at grass roots(good friend/guy) he tells me i need a new transmission and the dealer should have new this... I'm like No

OK so being a Yankee and all i called and asked for the general manager first thing, I was upset,..... but i got the manager of the service department first, so I'm like OK lets give them the benefit of the doubt and see what happens..

so next i get a call from them service manager and she tells me, that we cant figure it out with out looking at the transmission and that would be 7 hours of work and a 700$ bill for labor... but she would split the cost with me,,,,I'm like. OK you need 7 hours to see if there is something wrong with the transmission this time but last time all you needed was to take it for a test drive for 10 min why wasn't this done the first 2 times i brought it in? oh wait i know, maybe because i got a second opinion already and I'm not playing games any more....

so I'm like OK do it knowing that Dan at grassroots knows his stuff i was confident that he was right,

so after they take it apart i get a nether call from her saying you were right you need a new transmission and we are going to cover it and pay for the repair,,,,,I'm like thank god

But wait its not over i get a call saying they want to see the oil from the transmission that Dan changed, and they are on a hold till mini get the oil for analyzing and lab work,

so i drive two hours to get the oil from Dan , Dan is a smart guy and saved it knowing they would want to see it...i dropped it off last night at the service desk at mini ( the oil is black) and now I'm waiting for the next phone call to see what there going to say


what do you guys think of this and what do you think will be the out come?

I'm all like you know thinking it'll like prolly be ok, ya know? Cause they like already like said they'd like, cover it?

Next time like you'll be a whole lot smarter and not buy a car with a questionable transmission or some other expensive repair looming - follow your guts - it told you there was something wrong yet you bought it anyway.

Are they going to replace your clutch while they have the tranny out? I don't know how many miles are on your car now, but if not, I'd strongly consider paying for the parts and having them put a new one in....

I think it's highly unlikely that they are actually doing 'lab work' on the oil. As they would say in Nascar about your trans: "****'s broke". Hold your ground, and if you think that a huge bill is coming, consider sending it to Zippy: Grassroots will be a lot cheaper and every bit as good.

the reason i bought the car was because of the reassurance i got from the used car manager and i trusted the dealer...
52000 miles on it now.... and they are putting a new clutch on the car which is 500$

ya Dan is the one that told me they would send the oil out but who knows what they are doing with it

I gave you some solid advice - I wrote it in terms that I thought you would understand.

You have a problem with the way I write? At least I can spell, puntuate, capitalize and write in sentences that folks can understand, and isn't that the point of writing in the first place - to communicate?

The only thing I can say is the two reasons you give above never have, and never will be a good reason to buy a car. A used car manager is in the business of selling used cars, and will generally say whatever it takes to make the sale. The only people you should trust in a used car purchase are yourself, and your independent mechanic.

ha ha you spelled punctuate wrong after all that......FAIL

Ya well that is why i got the second opinion first before bring it back to them, give me a little back bone, plus i did have it documented each time i brought it in...

True but the car was under warranty the hole time i was driving it until last week..So im hopping that means something

Now I am confused. You aren't making this thread any easier to follow. Did you take the car to the dealer before the warranty ran out? If so, then no questions asked. They should honor the terms warranty. If not, and you have a record of all the times you took the car back, etc, you should also be okay. So what is the question again? Why me? You are getting a free transmission. Why me what?

lol why me is not a question..
I took the car to the dealer twice while it was under the warranty for this problem and the last time which was Friday of last week when the warranty just ended...

The question was what do you guys think will happen after they run their so called test on the oil?

The thread is titled "Why me"? That surely is a question.

This is not true of all car salesmen, but of many.... How do you know they are lying? Their lips are moving.

Be very sceptical of all claims they make. Get those claims in writing or they mean nothing.

When you went for Test drives was there a work order made up for the complaint ??
If there is its documented during the warranty period and should still be considered warranty
Salesman should also be held accountable if they tell you something isn't wrong when it actually is. "SHOULD" be held accountable

+1. The guy is having a hard time as is.

Try lodging a call with Mini USA. They may not be incredibly helpful, but may warranty repairs come out of their pockets and could offer to do somthing. I had some luck with the local Better Business Bureau on a different car in the past too. Good luck!
