R61 Awkward clutch

We bought a 2012 CMS All4 manual in July with 29k miles and traded in our 2010 Clubman S manual with 115k. My wife mainly drives the Mini's. She told me the clutch engaged really high compare to the Clubman and it was difficult to start from a stop with a shudder. Three weeks after buying it I was driving it and after a red light I accelerated and when I shifted into 3rd gear I hear a bang and lost all gears. The clutch pedal is soft and no gear engagement. Had it towed to the dealer to try and get warranty and they say no warranty on clutches. I explain that it felt like something broke and there was no slipping prior. Dealer says if I commit to the clutch replacement at $3900 and they find a part broke then warranty. The dealer we bought it from has agreed to pay half of the cost to repair it at an Independent shop. Not replacing with OEM part for sure. The SA at the dealer in not so many words told me the clutch in the 2012 was too small for the weight of the CM and the All4. I wish I knew a way to negotiate the clutch replacement with the dealer since they mad a clutch change for 2013's. That makes a statement that the 2011 and 2012 had issues from the factory.

The CMS has been sitting at the dealer for a month waiting on a thermostat under warranty. They put us in a rental car while we wait. Yesterday they said we were 15 on the list and they are getting 5 thermostats in per week, so rental car another 3 weeks.

Well I got my 2014 Paceman back. They replaced the full clutch system flywheel, pressure plate ect (under warranty). Their report states that they noticed it was worn ect. So I'm happy to have a new clutch and I can now make it up a hill pretty much. However, its still not sporty at all, it seems very light and and I cannot do a fast takeoff no matter what. If I were drag racing I would definitely loose. So my question is, are all Pacemans like this or is there still something wrong with my car? I had an 04 Cooper S and it did not have this issue.

So exactly what years Pacemans had the clutch problem , I am about to buy a 2013 Paceman s All4, is this one with the problem?

Theoretically it's the 2011 & 2012 models. But if you are going to buy one i would suggest giving that clutch a bit of a workout and see how it responds.
