Bi-Xenon non oem?

As mentioned in an earlier thread my Mini was hit in the front when a vehicle backed into it at a drive through.

The other drivers insurance is paying for the repair (Hartford) However they have been in touch with the bodyshop stating they will only pay for an aftermarket Bi-Xenon headlight unit. This seems odd and not acceptable to me.

I will be contacting both the bodyshop and the Insurer. I am looking for some input from you guys.

Laws are different by state but here in Ohio I believe you can demand they only use OEM parts.
