MCS issues w/ P1497 code??

Hello

i recently purchased a 08 MCS and have had a few issues pop up here within my first month of ownership. Now i know these issues have been touhed in previous posts but im looking for some up to date information and possible solutions.

To begin the first issue i came across was a dead battery. the day i picked it up it wouldnt start so they charged the battery and set me on my way. 2 weeks later it dies and in the end i replace the battery entirely. now a week later on my first lenghty drive i throw a CEL and my reader gives me a P1497 error code.

so far what ive discovered is a crack in the intake tube next to the clamp that connects to the turbo (in the picture its where i have duct taped it for now). also there is a whistling noise to the left of the mini logo on the valve cover. almost sounds like its coming from the space between the air filter and the valve cover.

My question: is it possible i thru the CEL because of the initial crack in the intake tube which then caused a valve cover crack or damaged gasket? Does anyone feel this can be solved with just a new gasket and intake tube as opposed to the more expensive valve cover?
