R55 if car isn't to specs
if car isn't to specs
I have a question that has been nagging me ever since. I've read about nightmare stories involving the BMW-Mini distribution center. One involved BMW technicians accidentally dropping the upper deck of a transporter on a customer's car!!
The car was crushed! I cannot imagine how the poor soul must be feeling.
Another said he was so disappointed with his order: dealer missed several options and the driver side door was dented! He refused to buy the car. I don't know what happened after that because all buyers have to plop down $1,000 if ordering the car.
My question: what do I say to the MA if my order is wrong?
What are my rights at this point (when I get Kazzie and she has a dent on the side for example?)
Can I refuse the car if there are a few mistakes on the order or am I required by law to give the dealer at LEAST one chance to fix the problem?
At what point do I warn the dealer that I won't buy the car because they damaged it or made major mistakes on the order?
Any information would be helpful. Thanks.

I agree with cybergypsy, however, my MA gave me a print out of my order. I signed it recognizing that was what I wanted. Now if you did the same thing and the car has more or less options than what is listed, that's on them. However, if you more thoroughly reviewed the doc after placing the order and realized there is an issue, well IMO that was your fault.
I consider that a contract and its the buyers responsibility to make sure the contract is right. It's the dealers responsibility to fulfill the contract.
That being said, if they can replace your order and sell the first car, problem solved.

I asked my MA about this during the 'Signing of the Order' and he said if the car was wrong, they would order me another one and sell the mis-optioned car on the lot. MINIs were being sold in under 10 days in Nashville, per the MA last Jan.
Only trouble (and it really wasn't) was the MA told me my stock MC with no upgrade packages would have the electric fold-up mirrors, which it doesn't. Of course, when he said that I already knew that wasn't part of anything I had purchased, but he kept saying it could be locally done. It wasn't, but I really hadn't paid for it, either.

Assumably you signed a contract that listed your options. Your MA should also confirm your options with you right before your MINI goes into production. You should check carefully that it is what you expect. Once the car comes in, check it to what your ordered. If it isn't right, then don't take it, unless of course it has extras that you didn't order, but would love to have!
I ordered a Chili Red Clubman in December of last year. Then, on Feb. 15, I changed my order to a Hot Chocolate after they had already built my Chili Red. My MA accidentally put in Piano Black trim on my HC, but the order went through immediately and the only way to change it would be to wait for another slot. He would have taken the extra cost off, but I asked for free sport stripes instead.
So you have many options if there's a mistake. Refuse altogether, re-order, or negotiate. However, you will know a long time in advance if they mess up the order because you can see exactly what options your car has on the owners' lounge.

My car was delayed at the port while a small scratch was repaired. I was ready to re-order and warned my MA about that possibility. Once I saw the car and found no visual trace of any repair, I took it.
My MA was more than happy to refund the $1000 deposit or reorder if I wasn't happy with it. And he was nice enough to throw in some accessories (driving lights, mud flaps, mats) to lesson my aggravation for the extended wait while it was repaired.
