I dont know if I would sell a car for less than its market value just because its bought by another member,Maybe a close personal friend,or a family member.If you love the car so much why are you selling it?????

Just means that the guy gets blacklisted at san diego toyota. Glad I know this since I buy alot of cars for family members and since they are all in san diego, just means I go elsewhere. Any time a company hires people that are like that, means I don't do business with them. Thanks for the heads up.

Sorry for the trouble richard, I understand how you feel.

Funny, I saw the first pic and my first thought was "Richard, how could take a picture of a dirty car??!"

BTW, I checked with my banker and it IS common practice to place a hold on the funds (some only give you access to the first $100!!:impatient) for 5 to 11 days, even though the check will be processed in a day or two.

Hey, if you want to kick start the guy's payment on his karma credit card, you could probably get a hundred or so NAMmers to call and schedule appointments to see the car (preferably after hours) and then not show up.

I agree that since you got the price you wanted you shouldn't worry about it anymore. But on the flipside.......

You cant' trust anybody anymore, especially when it comes to selling vehicles. There are so many con artists out there and so many different scams that no one can keep track of them. I've been in the situation and it taught me a LOT. Essentially you let them drive away assuming they were legit. I hope for your sake the money will be there. If it's not, I guarantee this will be a hard lesson learned for future transactions.

Nice CAR! Sorry about the guy being a freak. I just sold my 2004 Mini. I told the people that if they wanted it that they needed to bring me cash or money order.

I just looked over the Pennsylvania consumer protection laws (and I am 100% POSITIVE THAT CALIFORNIA IS TOUGHER) as reiterated by my automotive business teacher.

It claims that you must not state any false fact. Well, it wasnt a trade in. This guy deserves to go down. I dont know why, but this guy being a sneaky tard like that really grinds my gears (and I have a 5speed:impatient)

So did your check clear? A 5 day hold on a local check strikes me as a bit much. Maybe your bank is placing the hold so they can use the funds for 5 days???? I have deposited checks for north of $1.0 million (non-Cashier's Check and out of state - as in across the country bank) and the funds were available within 2 business days. Part of the rationale for implementing a paperless clearing system was to avoid the uncertainty attached to waiting for a physical check to be presented to the issuing bank for payment. Frankly, I think your bank has already received the funds and is using them for their own benefit. If the check was refused, you would have heard about it by now. Don't mean to add to your feeling of being abused, but....

I deposited the check last Friday, immediately after the transaction. I called the bank yesterday and they said it's on hold until the 8th. I had called their corporate office and they said it's standard policy for them.

Yes, that's what worries me. Thanks, me too. The banks say it should be fine--but I dunno.

After I get the money, I"m going to send an email to Matt Duke--the supposed buyer of my car, and ask him to join my MINI club.

If anyone responds to the Craigslist ad, make sure to inquire if the spare tranny comes with the car!!!!

The old "standard policy" ploy.... Is your bank by any chance, Bank of America? Well, your hold period is almost up. And, if your bank is BofA, they would have been all over you if the check had bounced. But, they did have your money within 2 business days.... Again, I am not trying to add to your misery, but....

How is it kiting? Kiting is where you write a check without the funds in the account to cover the check. As you mentioned, before a bank writes a Cashier's Check, they pull the funds to cover the check out of your account. It is an abuse of the customer account to put a hold in place for a period longer than it takes to actually receive the funds for the respective check that was deposited, but some banks are more prone to abuse than others.

Also, check the fine print on the deposit account agreement - interest (if it is an interest bearing account; demand deposit (traditional checking) accounts are not generally interest bearing) is not calculated until the funds are available in the account. A hold makes the funds not available for the interest calculation. Therefore, presuming the bank had the funds inside of 2 business days, they got free use of them (could write loans against them as well as did not have to pay interest on the funds) for 3 days. As I said, some banks are more prone to abuse than others.
