R50/53 Is this under warranty?

Is this under warranty?

I have a 2006 MCS. I am the second owner; it has another three years, 45000 mile warranty. This morning I noticed that the seam on the driver's seat was unraveling. The seats are leather. Is this a warranty issue or would it be considered wear and tear?

I would think it would be warranty. Unraveling seams are hardly normal wear & tear. Get it in & have them check it out before it becomes worse.

I think it would fall under warranty. My cupholder was replaced (it was broken when I bought the car) for free, during warranty, last week.

Thanks for the advice. How hard should I press the warranty issue? I called and made an appointment for next week, but when I spoke to the service person she said that items were warrantied "when it was a factory defect." I'm a pretty big guy--270 lbs. Nonetheless, I don't think the seam should be unraveling. If I put a hole in the seat or something, I could see that as wear and tear. What do you think?
