Well that was stupid of me(re:JCW exhaust)
I did not know that the JCW exhaust that came on my factory JCW Clubman only has 1 catalytic converter(downpipe). I had purchased a Riss Racing catless downpipe thinking that the JCW exhaust has 2 cats, similar to the S exhaust. So exhaust shop won't do it(I found another that will but do not want to fail emissions), what options do I have? Buy a high flow catted down pipe? Is that even worth it? Swap to an aftermarket exhaust that has a cat beyond the downpipe?(Is there such a thing?) I can clear the CEL's via AP but I'm guessing without a cat, clearing the CEL will still cause a fail on the emissions test, right? I'm located in WI if that makes a difference.
Just wanted to add: It's against federal law to run a vehicle without a catback, that much I know so I guess that should answer the latter question in regards to whether I can still pass emissions via AP's CEL clear.

Akropovic(sp?) is the only option it seems? Isn't it still illegal to swap the cats though?
(almost)Any catalytic converter that has the right diameter (to match up with your exhaust) will work. Think of it as a filter for your exhaust.
They can cut out a section of your stock exhaust and weld in a cat. As far as I know, emissions testing is done by reading the exhaust gas as it exits the tailpipe, so as long as the car has a cat you shouldn't have a problem passing.

If you're in SoCal I'd recommend going to my friend's shop and he'll do whatever you want with your exhaust. His tig welder just came in, so he's going to fabricate an exhaust for me soon. 3" all the way back!

If you want a cat the Akrapovic Downpipe is the way to go. Unless your emissions test in WI actually sniff test the exhaust you may still pass even without a cat. Prob is you won't know till you test it out.

Cool, we actually are selling the AK downpipe at the old price as there is a price increase that is been sent to us, so we are going to sell at this old price till christmas to save some people as we know for 100% it is going up in price.
Fast Intentions in Simi Valley, CA, will also do whatever you want for an exhaust as well. They do a lot of work on BMWs and some MINIs as well (including mine). Great guys and excellent work.
