Anyone go thru getting their deposit back?

I searched but couldn't find exactly the answer to my question. Short story, wife is expecting so we have to consider getting a bigger car than just me having my MCS as a commuter car. Anyone know the process of 'potentially' getting my deposit back? Do i get it back once I found someone to take my MCS off my hands? Note: I'm still working on the wife to let me keep my commuter car and just having one 'family car' vs. two!

I put it in the contract that I would get my deposit back immediately if I chose not to take delivery. They wrote it down and authorized it.

AFAIK California law states that you must get back your deposit if you back off on an order. Do some research, you might have to get a lawyer if the dealership is stubborn.

i used my credit card for deposit, if they refuse or put up any kind of delay i can always have the CC company do a charge-back immediately...not that i plan to do that but i figure its easier than doing it with a check and asking for money back the old fashion way...

back in 04 I had no problem getting my deposit back from eastbay mini. i just told them i changed my mind and 3 days later I got a check in the mail.

I asked for mine back from Mini of Irvine. they seem okay with it...should be sent to me shortly said my sales guy....

HA! hilarious.

From what I understood with mini in Calgary, Canada, if I see the car and don't like it, they'll give me the 1000$ back on the spot and sell it to someone else.

Yeah. I mean, isn't that what roof racks are for?

As mentioned above, California law dictates that your deposit is refundable. But I hope that you won't need to get it back...

Hahaha, I used that line with the wife already. I logically argued that we would have the car for at least 5 years and by that time he will be off to school for me to take him and pick him up and therefore perfect time to get a new car. I thought that was a winning logic that I already offered to take and pick up the kid. Sigh to no avail.

Calif law states that you must get your deposit back.

Only way you won't is if you put the deposit as a payment, which would require a loan amt, % rate, apr disclosures, etc...

You can get it back. All you have to do is ask.

I used my credit card for my deposit and was able to get it refunded when I could not take delivery of the car. After I couldn't initially take delivery, miraculously the car was still there a couple weeks later when I could. Full story here if you care to know why I yo-yo'd:

I do know someone at work who has a MINI and a brand new baby and he's not giving up his car.

In the US, it's state by state

as to if the deposit must be refunded. If you're buying in Canada, check your local laws.

FWIW, I take two kids to daycare three days a week in a Mini, so there should be no need to not get the car.

Ok, I lost the battle with the wife. I have to let my mini go. I'm on the Traviata and should be at the dealer sometime mid to late October. My build is in my sig, but not sure if this could work, but I'm happy to work with anyone who is interested in my ordered Mini to see if you can just take it so you don't have to wait and not pay above MSRP. Not sure if that's doable, but figure I'd offer and see how we can make it work! Anyone know if this is something the dealer would allow?
