Just sue Mini, loose, and waste a bunch more time and money. Just do it.
Fact is that someone broke into your ECM and changed the programing. There is NO WAY in heck that you will even come close to winning this. Even if it wasn't the tune, it's the fact that you had the most important piece of equipment altered from factory spec. You did brain surgery on your car!! And now you want the dealer to step up and cover your blown up motor??
Here is a warning to ya also. As much as your tuner is beating his chest now, don't expect to see him in court. He will disappear, guaranteed.
But, this would be fun to watch. So just go take care of business and let us know how it goes.

The tune I got was from Jan and I tried it at the MINI Thunder II event at Thunder Hill. It was a canned tune that he has been using on that motor for several years. It was not a custom tune on a dyno. Jan has not had issues with this tune in the past. I ran it the final day at TH and I hadit on the car for the drive home and acouple days after I got back. I removed the tune at my wifes request 6 weeks prior to my motor burning down. For around town and city driving it was not that user friendly. Throttle was to on/off for the wife. You were not paying attention it was a bit harder to launch the car and
it had to be in sport mode. This was a very safe conservative tune and it ran fine the days it was installed. Teh car started a wierd idle before the trip. Could be the high pressure fuel pump going out but the dealer is not willing to look for that- only an excuse to void the warranty. The car had been on I-5 for 5 hours straight and burned down at around 70 to 75 MPH in 6th gear and I think I actually had the cruise control on because I was on the phone at the time with some work calls. The tune was not installed at the time of melt down and nor had it been on th car for 6 weeks prior to the issue. The tune had nothing to do with why this motor burned down. Until someone opens up the motor you will never know. After the way MIINI ad the dealer are acting I wouldn't believe anything they told me unless I had a non biased Indy there to verify the results. The program is said to bump the rev limiter a few hundred RPM and the MINI says the car was overreved but will not say what RPM. Others who had burnt down and showed overrevs where told what RPM they hit. They now claim they put the reason for denied warranty work in the PDF document they sent me with the 8630.12 quote. This is for a remanufactured motor with a 50K mile warranty or it drops a piston. Which ever comes first. The later I am sure. The Indy quooted me $8000 for a brand new crate motor. I sent the PDF back to Lithia asking them were they showed the refused warranty repair. The reason is said to be 5 over revs. I find that very hard to believe but it is possible with the wife and other who have driven the car. Valets have had it and so has the detailers for over a week and they moved shops 20 mile away during the process. I would like to
know the RPM's. Not sure what is true and not true at this point. I love all the guesses but until the motor is cracked open we will never know.

Your not using your common sense here I'm afraid.
No matter why the car died, the fact is that you broke into the car's brain, main frame, hard drive, whatever you want to call it, and diddled with it. You can't do that with ANY product, being car, computer, wall oven, and think that when it all goes wrong they won't point to the fact that you, or in this case your tuner, is a NON trained Non certified, Non licenced Mini tech or mechanic had NO business reprogramming the ECM! I don't care if the transmission fell out, they would find a way to tie it to this.
Your frustrated, I know. We do get it. But NO ONE should think that they can have their car's ECM broken into and still have any kind of valid warranty. The unfortunate truth here is that Mini USA may in fact have reason to have issues with your particular tuner. They may have more info on him then he would ever admit to.

There was mention of piston damage etc earlier in the original thread that is now approaching 10,000 views (post #49 dated May 1st), so it has been opened looks like......

I love the fact that right way trhe dealer is assuming it is my fault. We need to determine who is going to be paying for the work. I can assure them if they think they will be getting the work if it is on my nickle they are smoking crack. Car is 3 months old and they have issues if chunks are breaking off the pistons.
Sounds exactly the same as my car. 6 gear on the freeway after 300 miles of highway driving. Codes present at the time where engine misfire. I asked them for an update and exactly what they saw on the piston. I was told chunks out of the side and also a hole in the skirt. Trying to confirm which one it is. No response. I called MINI USA who is contacting them and I also called Seattle MINI my selling sealer. Seattle MINI told me to come by if I need a car no problem. We discussed getting the car to Seattle so they can do the repair. I did the same with MINI USA. I got no response back from PDX to my e-mail. Not surprised at thsi point.
