02 & 03 Mini Recall Notification

I received a recall letters from MINI USA campaign number: 04E-A01 regarding Tank leakage Diagnostic Software on some 02 & 03 models, and
Campaign # 04E-A03 to replace Crankcase Breather hose line with upgraded brand. Any1 receive similar notice?? On the Diagnostice Software
they have to update the engine control module with the latest version...
FYI for those who owns 02, 03 04...

Nope.
My mailbox is empty except for election info and bills.

My MCS was built 10/02.

FYI for those who owns 02, 03 04...
I took my 02 in for something else and they did the service while they had the car.

My 02 MCS is in the shop now for something entirely different, and they performed the recall upgrades.

also had update installed last week in my 03 MCS (11/02 build)- it's version 39.1 - not sure if its full ECU upgrade or just dealing with gas vent issue. I previoiusly had V 36.1 softwareinstalled which solved my long time stumble issue-
Glen (shop forman) came to be sure i knew that since i had aftermarket pulley my warranty was void. He said if i had further issues with the DSC light coming on it was due to the pulley and wouldn't be handled under warranty. He also told me the pulley voided the warranty completely on the engine.

I got THREE of those recall notices in my mail on Thursday. I promptly threw them in the trash can since I don't have the cars anymore. It is strange that the manufacturer doesn't know that I no longer own these vehicles.

Barry - As for your car, I'm sorry to hear of your continuing battles with the stealership. They CANNOT invalidate your warranty just because you have aftermarket parts on your car. This action of theirs is ILLEGAL and contrary to the Magnuson Moss Warranty Act of 1975.
No warrantor of a consumer product may condition his written or implied warranty of such product on the consumers using, in connection with such product, any article or service (other than article or service provided without charge under the terms of the warranty) which is identified by brand, trade or corporate name... (15 U.S.C. 2302(C)).
The jist of it is, the onus is on the stealership to prove the aftermarket parts caused the malfunction. If not, they must repair the car under warranty.

How can a pulley affect the DSC? The pulley merely allows more air into the engine as the sc now spins faster. The DSC system works in conjunction with ABS and detects differences in wheel speed. When there is a difference in speed and wheel slip is detected, DSC will equalize them via application of brakes or shutting off fuel to the engine. The two systems are pretty much separate.

With all the warranties that MINI is voiding due to aftermarket parts, has anyone asked them to prove the parts caused that malfunction?

What if you somehow had a JCW 15% pulley without the rest of the JCW kit? Would they invalidate your warranty also?

This action by MINI USA is "chicken kukai" and is just begging for a Class Action lawsuit.

Here's more info on Magnuson Moss from SEMA, a group that is well versed on factory warranties and aftermarket parts.

When I got home from the Fall Dragon trip I had both notices waiting for me in the mail box. I’m going to have the breather hose replaced, but because I live in Florida and they have no smog checks here I’m not going to have the updated software installed. I’m running on the original v 32 and my MCS has always performed great so why should I change it. If I ever move to a state that requires a smog check I’ll think about upgrading at that time.

I want to know if anyone has installed the fixes to these recalls and had-

No ill effects.

or

Yes, ill effects- namely worse performance, stumbles, yo yos, or Service lights or other dash lights coming on (after the recall fix visit was done).

That breather hose is the same hose for the PCV valve that I already replaced but I guess they have a better hose now.

'03 MCS here, got the recall notice to update tank leakage diagnostic software. I haven't had them flash the ECU because I was okay with the performance and didn't want it to get worse. Surprise surprise, once I got my car back, my stumble was GONE! Needless to say, I'm quite happy.

just last week got the tank leakage recall thing x 2. i'm waiting for the jcw upgrade kit to come in though, so i can do it all at once.

and my old sg/b cvt mc is supposed to be in thailand. i assume even if i were able to get in contact with the owner, he wouldn't be able to follow thru on it anyways.

I had 3 recalls done on my 03/03 S
Diode replaced or added for the power steering fan solves fuse blowing problem???? Hadn't even heard of it
and the other 2 mentioned here.
200 mile trip to dealer 26MPG on the way there
200 mile trip home 30MPG Best I have ever gotten.
Running smoothe
no complaints so far
Feels like it has more power
so far so good

Brad, They installed 39.1 when i brought car in for another issue, i had 36 before which solved my stumble issue and i was pleased with it. I don't notice any difference at all with 39.1, can't say its any better and thankfully its no worse.

Getting ready for Track Day on Sat & Aloha 500 in few weeks-- Had my belt replaced today with same NAPA belt that Helix installed-just to be safe since its been almost a year. It was just starting to shred at one point on the side but didn't look to bad except one spot. Bled brakes, changed oil and tomorrow will install new Ferodo 2500 pads (my old Ferodo's have 13K miles on them and about 1/3 pad left). (i have the motive bleeder if anyone wants to use it)

I had the recall upgrade done just over a week ago, and Sadie has never run so well--not even when she was brand new!

I never received the notice but heard about it here. Crevier is booked up for weeks so I am going in on the 23rd. I hope this solves my issue with the fuel gauge not registering.

Before I could decide what to do about the recall, my SES light went on with
some associated engine weirdness. I figured that this was what the recall was aimed at preventing since the warning had to do with the emissions control system and the dealer flashed the ECU with V39. The car seems to be running fine now, however.........I'd like to know if this could in any way effect my GIAC re-mapping. Anyone?

yay!!!!! i took my MINI in this morning and boy does it run like a champ!!! I took it in for the recall/reflash thingy, to check my battery, to check on stalling issues, starting issues and accelerating issues. On my way, my window didn't do the "drop" but when I got there, it fixed it self! When the SA came out to my MINI, I said "you just missed it, my window was broken just a minute ago!!!" he looked at me weird, but then when he moved my MC out of the driveway, it happened to him. Yay, so they fixed that too. They even cleaned and adjusted my windshield sprayer jet things that made most of the water miss the windshield completely. The best part is that it feels really different to me. I noticed it immediately. I'm hoping things will get even better as I drive it....I've read others boast better gas mileage, so I'm crossing my fingers.

I almost want to keep my MC forever and not get my Cabrio....

just p/u my mini today for the recall and jcw upgrade. not sure which did what, but all i can say is it's soooo smooth now. no jitters, bugs, hiccups whatsoever, even when i repeatedly sped up and slowed down in 2nd, trying to simulate stop and go traffic.

i cannot recommend it enuf. of course, i'm not sure if it was just the recall or both the recall and the upgrade. but getting them both will make my daily driving that much more fun, no doubt about it.

I did my software recall this past Sat. and so far have not noticed any difference. Wonder if I need to reset the ECU in this case. Had my problem with driver's side window fixed at the same time. Thanks to Jenny for the excellent service and for the prompt shuttle ride.

I was waiting to get the recall done until my second maintenance service (due next week), and when I went to schedule an appointment.....low and behold it was already done on another visit earlier

I think that was the reason for my improved gas mileage
I've put my MINI through its paces and the recall/update has no detrimental effects thus far
Kudos to Tony , taking care of his MINI peeps

I got the recall messages about the breather hose and v39, but didn't pay them too much attention. Later, I got a reminder notice from BMW. A few days ago, while installing a parking permit on the widshield, I noticed a funny sound coming from the engine compartment. I looked under the hood and found a vacuum line had completely deteriorated. my dealer and he asked if I had received the breather line recall notice I asked if people had been reporting performance issues with the v39 upgrade... he said that if I wasn't having any problems , he wouldn't install the upgrade.

Mini had her yearly check-up last week along with the recall stuff. What a difference from last year. They have really improved the service all around- I was very pleased.
