My loaner was STOLEN!!

It's Sunday. The dealership is closed. I won't sleep tonight.

I have filed a police report.

Does anyone have any insight to make me feel better.. Realistically? I'm upside down in my JCW already and trying so hard to pay it off. I don't want to be liable for a brand new ALL4 now too :(

I do have comprehensive insurance but I don't know how much that matters compared to the dealers insurance... And if my renters insurance might do something because it was in my driveway... I'm just at a loss.

I'm not an insurance expert, but between your insurance and the insurance I'm sure the dealer has, I really doubt you're going to be on the hook for paying for a stolen car!

I'm not sure how you could be held liable for the car. It's not like you wrecked it or were in any other situation that you could be held responsible for. I'm sure between your explanation and the police report, you're in the clear.

Where was it parked? Make sure it was not towed for some reason. Another member just thought his was stolen also but it was towed and not reported to the local PD.

It was parked in my driveway. I unfortunately don't know of any reason it could have been towed.

I'm dreading calling the dealer tomorrow. The worst part is, I still need a car ha. Once my repairs are finished, can they hold my car until the loaner is returned? The PD seems to be confident they'll find it. I just hope it's in decent condition. Does anyone know how MINI's insurance treats that? I didn't even sign anything other than the damage evaluation before I took the loaner.

You should pray that the loaner has LOJACK fitted, coz when I get a loaner, sometime they have lojack stuff in the glovebox and I asked the service advisor and he said all loaners in the dealer has lojack, not sure different dealer do things differently.

You would be liable for the deductible on your comprehensive at most, but as stated before,
I doubt the dealer would pursue you for it. They are insured and its no fault on your part...

Do you still have the key? If it wasn't towed away, and you still have your key, then somebody else had a key. Someone from the dealer perhaps?

If you did not sign anything other than the damage info sheet the dealer may not have realized that it was loaned out and noticed that it was missing. They may have then "recovered" their loaner car.

Wow! Sorry to hear that. I would think that your auto insurance policy will cover the loss of the loaner.

Depending on your states laws either your ins is primary or the dealers ins is primary. If yours is then you would be responsible for what ever your ded is. If your ins declines coverage then the dealers ins will pay. The bad thing is due to extreme costs for a loaner fleet the dealers ins ded is usually 1000 or even 1500. You would be on the hook for that amount. Legally loaner cars differ from rental cars as you did not pay for a service. They gave it to you at no cost. This is also a state by state law so YMMV. It's the same as if I lent you my car and it was totaled or stolen. Your ins has nothing to do with it as it's the car that has coverage. Having the police report and the key is crucial.

Just throwing this out there... I had one time as a service advisor where we diagnosed the customer's car, and they declined the repairs. After 5 days of them not returning the loaner, I ended up grabbing the spare key and getting it from their house...

Haven't eared that one before!!! ouch . . . sorry to hear this.
My 2ç advice. Contact the dealer asap. The more you wait the more you'll become suspicious in their eyes. Keep in mind that it's a loaner so it's their car. Not reporting it to them has probably worse consequences than dealing with the awkwardness of the whole thing.
You still own your car so they probably can't keep your car. Having all parties involved (Police, insurance, and dealer) is the best to show your honest intent.
I found that usually people are understanding when they don't feel cheated.

Thanks for all the replies everyone.

As of right now, no notable updates. I spoke with the service manager at the dealership and he sent me a form to fill out a statement and provide the police and insurance claim numbers, saying it will get their insurance in contact with mine and the P.D. Hearing "this is not good" from him made my stomach turn. I just hope they find the car in good condition. I need these little punks to turn on my Mac that was left in the boot so I can get their location!

Did you leave the keys in it?
Unless it was towed away, mini's are so hard to steal....the antitheft system is very effective....
Wonder if the dealer can account for ALL the keys...
Maybe a prior driver "lost" One...followed you home...took the car....

I don't think I can afford that deep of wishful thinking

But the keys must've been left in, I don't have them. I came home Saturday afternoon, sick. I had things to do that day, I didn't expect to be bed ridden until the next day

Damn dude. Left the keys in the car, unlocked? Apparently Salt Lake is dreamland cause I might get caught with my pants down and my keys locked inside (has happened three times, I'm a slow learner) but NEVER with the car unlocked and my keys inside. I just lock the car... like, to not do so doesn't even compute in my mind, it's the same as putting one foot in front of the other you don't conciously think about doing it

Almost too crazy to believe...
Sounds almost like you sold the car...and reported it missing...just kidding there...but you bet the insurance agent will be thinking that....be ready for the question...

Sounds like you might get lucky...
Somebody might be out joyriding....
And there might be a few THOUSAND DOLLARS IN DAMMAGE when it is recovered....
Leaving the keys in ANY CAR is crazy, especially one YOU DO NOT OWN, BUT ARE RESPONSIBLE FOR....
Ouch.

You really think someone would do that, just go on the internet and tell lies?


He mentioned he didn't have the key, so he may have just left them in the car, and an opportunistic criminal just happened to peek in and realize he'd hit the jackpot.

I live in a low-crime neighborhood and I still double check that all my windows and doors are secure and the keys are in my pocket, but I'm a little bit OCD.
