Accident

Today a lady pulls out from a side street and collided with my car. She claims she did not see me approching, funny how everyone else did. HOW ABOUT PAY ATTENTION WHEN BEHIND THE FREAKIN WHEEL.

Right.... Didn't see the bright blue car..... Luckily (sort of, an accident is never lucky) that has absolutely no bearing on whether it's her fault or not. Ride her insurance until everything is in the same shape it was in before, if not better.

At least it appears nobody was seriously injured. Be sure to take a lot of pics, get a police report, and of course her insurance info. Good luck!

Thanks for the support. Now the real fun begins, having to change my schedule around, finding alternate transportation, ..... etc. Yeah what fun! . I took pics of the wreckage, will post them soon.

Well, maybe not.

She could have been dialing her cell phone, Eating, putting on her makeup, Checking her E-Mail,or anything else except paying attention to where she was going. It sure as hell she was not looking if every other driver seen Tmini08 she sure was not paying much attention to her driving.

I see people doing everything in there cars except paying attention to their driving every time I go out.

Whatever she was doing she was not paying any attention at all to her driving.

other drivers can be so annoying!

Just wanted to let you know I feel your pain! Sorry to hear about your accident. That bright blue is so beautiful. So sad . . . But hope you get your MINI back soon.

Thank's for all your concerns, I just finished talking to my insurance company and a lawyer. My car(ZIM) will get looked at today and I should have an estimate of the damage. My insurance company is going after the other drivers insurance company for all damages/repairs. I will be speaking with the lawyers today as well, as soon as get back from the doctors office, I am starting feel some pain and discomfort.
I also posted some pics of the damage in my gallery.

WOW!!!! Glad your ok but at least it looks like the "crumple" zones worked as designed!

And definitely don't forget about all of your "pain and suffering" when talking to the lawyers.

One other thing -- in addition to the obvious injuries that you suffered -- you should compile for your attorney a list of all of the activities which you have done with your Mini to show him that there has been a loss to your daily life and recreation.

Sounds crazy, but talk with any motorcyclist who has been injured in an accident. You'll find that there is always a computation for loss of the life activity which you used to enjoy before the accident deprived you of that source of enjoyment. A Mini is not just a car.

Is talking on a cell phone, and/or texting while driving illegal in your state?

Do you even remotely suspect she may hvae been doing either of theses while she was driving (her getting out of her car with a cell phone in-hand is a clue)?

If so, make sure your lawyer subpoenas her cell phone records. In some states, in some cases, such willful negligence can mean she is liable for up to triple the damages.

From what I could see, she did not appear to be on the phone. I believe she just did not look before pulling out into the intersection. The funny thing about it there were at least three cars coming through the intersection from the opposite direction. If she would have made it across she might have been plowed into by the on coming traffic from the other direction.

Based on the original description, I could have guessed that she was driving a Bimbo Box, the pictures of the Lexus there have confirmed my hunch.

I Haven't seen him on here much since he wrecked his MINI, but try and contact OrangeCrush (Mark) to get a second opinion on the Damage through your pictures. Sure he will only be able to give a rough estimate, but He has lots of time on MINIs and can definately Ball Park it to make sure the adjuster isn't shorting you.

but I am glad to see that the MINI kept you (relatively) safe! One of the reasons I bought my MINI was because of the seemingly impressive safety features. Your pics made me feel so much better about getting my MINI. Good luck with everything, and document everything that goes on. Take notes on every conversation you have with the insurance adjusters, medical professionals, any other witnesses, and the other driver, if you should be so lucky. You never know when you will need those notes.

Well being LBM owner I can tell you it is not a bright color that everyone sees. Most people do not see me and pull right out in front of me. I even have a white top that makes it stick out a little more. People just suck and any kind of effort on their part is asking way too much. Judging by the fact that she is driving a Lexus SUV she is probably a trophy wife that everyone caters to and she never has to lift a finger.

I have to agree, she probably is a trophy wife. Her husband pulled up in a Mercedes.
