Dr O's talking about the potential capabilities of electronic limited-slip systems in general, and not specifically about the eDLC used in the MINI. As he said, there are a LOT of different implementations of electronic limited-slip differentials out there, with varying levels of sophistication.

You may in fact be correct, but the marketing descriptions from MINI aren't definitive one way or the other. In much the same way that ABS systems are described in marketing materials, their statements would be correct either way, whether the system waits for the onset of slippage before braking the wheel or brakes it pre-emptively.

As I said before, the only way to know for certain would be to find a technical description of the eDLC system and associated algorithms used in the MINI.
