Absolutely, and not whatsoever; "It depends". What's your question?

When my mechanic took off my downpipe he was looking at the wastegate and it was open, he said he has never seen a wastegate open like that but he said it might be different on the Mini. He said most Turbo wastegates are closed. Any idea?

Find a new mechanic that knows current BMW operation. He is traditionally correct, most off-the-shelf aftermarket turbochargers use default-closed wastegates with calibrated springs to open at a certain boost pressure, however this has limited control even with an EBC.

BMW chooses to operate their turbo engines with a default wastegate-open situation, and a vacuum pump is computer controlled and pulls the wastegate shut depending on operating conditions and driver input. It will only pull the wastegate shut when enough torque is requested the engine operates with boost.

I hope that helps,
Ryan

Do i suppose to modify the wastegate?

only if you think HKS and Greedy know more about the MINI than BMW does..
