What it really means is that no one can afford the legal bill if the dealer makes a stink. Don't think that's true? One of the NAM members who owns his own company with lawyers on retainer started a tussle over this very same issue, and gave up.

On paper they have to prove it.... But what if they say "it caused it because of changes to the way the car ran resulted in increased stresses blah blah blah. " What's it take to prove them wrong? If they don't cave under threat of a MM suit, then they'll never cave....

Ok well I'm going to chime in and be an idiot. I was wondering if anyone could explain to me what exactly will be coming with all the JCW upgrade stuff? How will it work? What will it include? etc. etc.

You can check out www.motoringfile.com for more info on the JCW kit than you could ever want!

5 Days !!

Well I finally had time to sit down and read the MINI bulletin on the JCW kit.

The release code can only be created in the coding station in Mt. Olive, all kits will be shipped from the Mt. Olive RDC, leading to a general 5 day delivery time. so I will get mine on thursday 7th.

yep!!

I'm the guy Matt was referring to.

This is dangerous view to be sharing. The dealer doesn't have to prove anything and most people and Vendors have no idea what the Magnussen Moss Act provides and what protection it provides you.

I've talked to retired federal judges who think it's a riot that people are so shocked when a car manufacturer voids warranties for aftermarket parts.

The fact is, if your warranty is important, have the JCW kit installed.

What it boils down to - you can install a Fram oil filter made for your Mini without worrying about the warranty.

You cannot install a performance enhancing product and expect the same protection.

I'm glad I read this. I've been pondering a laundry list of mods, and will keep this in mind. Ultimately we're dependent upon the good faith of the dealership and the manufacturer. If there's ever the slightest suspicion (or even none at all) that a mod caused an expensive problem, all bets are off.

I'm curious, has anybody ever obtained more than a verbal approval of a 3rd party modification, and if so, used it to enforce a warranty?

Yes...

The Fireballed cars are sold through a souther california car dealership with warranties. I've talked to another tuner who is doing performance packages for a dealer on the east coast as well.

Interesting, but not quite what I meant. I'm talking about aftermarket products installed outside of the dealership. Are there any bankable assurances to be had?

is it's a case by case, dealer by dealer situation. The dealers that offer mods other than JCW are more mod friendly, and some dealers that don't offer mods use common sense. But if they don't want to accomidate, you're hosed. And if you think you have a good argument against them, you're STILL hosed.

This is an area where there is no fixed answer (so I guess the answer is "NO" to the bankable assurances question), and each owner treads down this path as each feels comfortable.

Personally, I didn't really care and modded away. One way to get some of the benefits without the risks is to improve the suspension first, it will make you faster, and you won't be putting drivetrain coverage at risk, unless you run into a total *****! Rear bar, camber plates and some sticky tires with light wheels will do wonders.

Ok...The kit is on my MINI.

Greg got it all ready in a few hours, I really do not know how many really but I will tomorrow when I go back.

I have left my Miltek exhaust on, to see what happens, I might put the JCW one to see the difference, at a later time.

I drove it for 10 miles and all in traffic. So, no fast runs yet, but it did pull harder from the red light.

I will go later to the sawgrass and run him a little.

More to come, I wish I would got a dyno first, but no time is the thing.

I received a call from my dealer today regarding my JCW kit. It has arrived and is scheduled to be installed early next week. However, I was told that my JCW strut bar would not fit with the new intake. Not to state the obvious but it doesn’t look like you have that issue. Any way to get a few more close up pictures of the strut bar and air box area to see the clearances? Did your dealer say anything about the strut bar?

Well I went for an hours ride around lauderdale west...Nice and cool out about 80's. I am very happy with the power and torque, If this is any sign, my DSC lights up on 3er gear, 100mph come really quick now, I can only say my Zero7 has cojones. I have a huuuge grin.

I would love to have LSD but I am playing with what I got and sure feels amazing now.

I can hear the turbo do Pssst! and my exhaust sounds great the same as always, I can feel immediate response when I press down.

I am not sure if I am going to badge him, or maybe debadge him and just use the front emblem, but I like my carbon fiber S from A.C.

Feels a lot faster, how much?, not really sure without a dyno. But, your dealer will NOT have one laying around for picking, you need to order it with your VIN number, the actual CD with the program comes with the last seven numbers of your VIN.
