Grrr I hate fender benders...
on second thought I don't really like cars. haha
I got in a very minor fender bender last night on 66. I was rear-ended after I came to a complete stop. It looks like the only damage was a scratch on the rear bumper. Not too bad.
But I called my insurance company and they told me, in the state of Virginia I won't have to pay anything at all since I was rear ended. And that I had to file a claim with the other person's insurance company. Is this true?
I would have let it pass. But if I can get it fixed for free, then I'll go for it.
I still prefer bicycles to cars.

Be sure..
Be sure, the metal bumper is behind that visible skin. The skin is flexible enough to pop out and look ok even if the structural bumper behind it is damaged.

BTW - looked like a minor dent in the door and panel below. Turned out to be just over $1000 in repairs. There was a crack to something else (I am not a technical person) that could not be seen.
I'm not sure of your question.
If the other driver is at fault, of course you have to file a claim with his insurance company. Why would your company pay the claim if it's the other guy's fault ?
And in what State would you have to pay even a nickel if the other driver is at fault AND has insurance ? None that I'm aware of.
Now... in States that have no-fault coverages, like Personal Injury Protection or Med Care, then yes, you would have payouts on your own policy. But since they are no-fault coverages, they have no impact whatsoever on your driving record or your premiums.
If you're still confused, try to ask the question in another way and I'll take another shot at it.
