After installing the new Dinan, I'm assuming you didn't reinstall the intake and everything is fine?
Going on the above assumption, my thought - just thinking here - is that (based on your description of the temps when the problem was happening) - perhaps the combination of Dinan, with the intake with theoretically more volume of air (CFM) is fine for temps above 40F. Below 40F, the air is cooler (denser). So perhaps the increased boost created by the Dinan tricking the ECU plus the colder/denser air from the intake somehow pushes into a range that the ECU doesn't like and thus throws an over-boost code. This tells me the Dinan for some reason didn't take this condition into consideration and adjust accordingly.
A good test (though you might not want to bother with doing) would be to put the intake back in with the new Dinan when the temps drop back down to 40F and see if the problem comes back. If it does, take it about and revert back to stock...do the codes come back?
I'm definitely not looking forward to this happening to me down the line.

TL;DR: So far, I'm getting 1mpg less than before with the Dinan Elite installed.
I am attributing it to my lead foot. With the increase in available power, I tend to step on it more, because it is fun, especially paired with the JCW Pro exhaust. I'm sure if I drive more conservatively (which is hard to do), the mpg would definitely go up.

I just installed the Elite on my 2017 Countryman S and love it! Immediately noticed gains in normal mode and smooth accelerations. The gear shifts are shorter and definitely more pleasant. I've tried Sport mode maybe 3 times in short highway runs and its pretty good also. Only had it a week with the tune, but plan to share more as I get more miles in.
My question is - Has anyone installed the Elite on a Countryman S, then did the JCW Exhaust upgrade and Tune afterwards? If so, please share your experiences. I'm curious to know if there are any noticeable gains in doing so.

I have been using the Dinan Elite on my 2018 Countryman S All4 for past few months. Also added the NM exhaust system. Elite needed dealer to clear codes after install as my code reader could not handle full reset. Elite works great! Nice boost in power in Mid-Balanced and Sport Modes. Expensive, but worth the money.

Because the JCW Tune updates all of the tables, it theoretically gives you more headroom for piggyback tunes. With the original Elite, Dinan used to show the differences between the BMWs with and without the M Performance tunes with the M Performance versions making more power and torque throughout the rev range. But since they've switched over to the Elite V2 versions all of those old graphs are no longer on their website.
