Mojito, I'm right there with you. Had all your problems except the clutch on my manual ALL4. Loved this car but was the biggest piece of crap ever built. I dumped it this weekend for a Focus ST and despite losing some $$$, am happy to never see it again. Leaks, gearbox, differential, engine power loss, limp mode, limp mode, limp mode, turbo takes a day off, CEL, drop off and pick up with CEL still on, drop off again and pick up w/CEL comes back on halfway home from dealership...
My neighbors had no Idea which mini I owned because there were so many loaners making special guest appearances in my driveway.

January, I live 3 miles from work. I did take it to Florida to get tuned right away so that was 3,000 miles

I've owned my 2012 CMS ALL4 since October 2012 ! I've installed an aftermarket intake, aftermarket exhaust, lowering springs( btw I don't recommend), just ordered my KW V3 coilovers, drive it 150 miles per day, six days a week, have accumulated 30,000 miles so far and NO problems at all!!! Get about 30 mpg on the hwy!

You are a prime candidate for a Lemon Law or Mag Moss Breach of Warranty claim. File, settle, walk away with cash.

To OP, I've just purchased a used CMALL4 manual with 1 year of factory warranty left. Have a service appointment next Friday to address drivetrain whine, broken lumbar, and some cosmetic issues (rubber peeling on steering wheel spoke), but nonetheless happy with purchase.
