Wheels damaged by sears auto center

Hey all,

I am trying to make the issue I am currently having with the company that insures the sears auto center as public as possible in order to force them to pay me for the damage done to my wheels while mounting my most recent set of tires. Below you will find a copy of the complaint I filed with the Better Business Bureau as well as the last email I sent to the woman who has been "dealing" with my claim. Sorry for taking up space on the server for such a stupid issue but these guys are trying to screw me out of over $400.00 worth of damages.

For reference, the BBB office I am dealing with is at www.chicago.bbb.org case # 94186298
The company the complaint is against is Sedgwick CMS Inc. Hoffman Estates Office in Illinois

Thank you for using the Better Business Bureau's Online Complaint System. Your complaint has been assigned case # 94186298.

Filed on : June 23 2008

Filed against :
Sedgwick Claims Management Services PO Box 95407
Hoffman Estates IL 60195-0407

Complaint Description:
After having 4 tires mounted on my car at a Sears Auto Center in Meriden CT and discovering significant scratches on all four wheels that occurred as a result of the service performed, my case was sent to Sedgwick CMS for resolution. The repair estimates I received total at $686.88 as all four wheels will need to be stripped and repainted due to the severity of the damage. After the initial phone conversation with a Latisha Tolever at extension 50969 1 did not receive the promised claims forms nor did I hear from anyone at Sedgwick. Over the course of approximately 4 weeks I placed about 10 calls to Ms. Tolever without a response. I did not receive a response until I asked for her manager Christina Scott extension 50683 and left her a message as she also did not answer her phone At that time I received via email the necessary documents and filed my claim. Again I did not receive any correspondence for several weeks despite several calls that were all unanswered and not returned When I finally received a response I was offered approximately one third of the cost of the repair as a settlement with the argument that there was insufficient evidence to show that the damage was a result of the service performed. I then sent pictures of the damage along with a description of how the damage was caused as explained to me by a service technician familiar with the mounting of tires. Again I had to wait several weeks despite repeated calls and was eventually told that there was still "no proof' and that the original offer of one third still stood. At that time I requested the necessary release forms be sent to me. I have not signed the forms at this time nor have I received any additional correspondence.

Your Desired Resolution:
I am seeking the total cost of repair of $559.68 along with the total cost of dismounting and remounting/balancing the tires of $127.20 as the repairs cannot be done with tires mounted to the wheels. In total this amounts to $686.88. At this time I have been offered $279.84.

Could you post pictures of the damage? It would be easier to get behind your cause if I could see the damage. Thanks
