Mini Cooper problem with autolights

Hi, i've a 04 pre facelift with RLS (rain light sensor) with the stalk with the "A", the issue is, with lights set to auto (position 3 on the stalk) the main beam are on permanently, why?

Then its coded with the DRL feature, mine has that as well. As far as I know, you need to use NCS expert to get that coded out
