I don't think anyone can really answer this. You should call a dealer or Mini USA and give them your VIN..

Too late unfortunately. The window for submitting claims ended some time last year.

it was not a recall

it was a class action suit settlement

and these expire while recalls do not

but it appears you did not miss out, as you were not included in the settlement: Class Member Definition

All current and former owners and lessees within the United States, the District of Columbia, and Puerto Rico of the following vehicles, manufactured at any time from start of production in November 2006 through July 2010 (“Class Vehicle”):

2008 through 2009 model year MINI Cooper S Clubman (R55)
2007 through 2009 model year MINI Cooper S Hardtop (R56)
2009 through 2010 model year MINI Cooper S Convertible (R57)

a few notes

1) the settlement includes an extended warranty, and you did not need to take any action to be included in the warranty part. The deadline that passed was to file a claim for prior work, of if you wanted to opt out of the settlement. (Read the "do nothing" item on that page.)

2) I got a letter saying my 2010 S hardtop is included, despite the 2009 cutoff (listed In the same letter). So it bears further investigation, but note they aren't doing anything unless you've had a failure,

Engine recall problem

I'm the second owner of a 2009 Mini cooper S. I bought it about two months ago and i was able to drive it around with no problem. Until last sunday night, it just wouldnt start at all. I called AAA and asked for a jump, but the car said it might be my timing belt or chain. So i had it towed to my house, and a mechanic from the dealership came and took a look at it, and he said the chain/belt was fine, but it needed an engine coil to be changed. We changed that. then he said it was a cam sensor...changed that also...it still didnt start. Then we noticed that the alarm light was constantly blue and the beeping noise it makes when i lock or unlock the car stopped....so he said it might be the immobilizer...

i had it towed to an autoshop who can reset the immobilizer/alarm, but to they told me that with the rattle it was making,...it was the timing chain/belt. I have googled this since sunday, and i have seen a couple of notices of the issue..I called the closes Mini Dealership, and gave them my vin number..he said theres no open recalls on my car...but there were warranties, but he didnt want to tell me what they were unless i tow my car there....i asked the towing company and the charge was $300 for 29 miles...

I'm a bit annoyed as I just bought this car...any help on this issue would be really appreciated.

My 2010 Cooper S hardtop wasn't covered but, because I complained of my (second) timing chain making noise in cold weather just before my warranty expired, the dealership offered a discounted price of roughly $600 as a courtesy. Also, because Mini USA agreed to pay, the final bill was roughly $350.

Would love it if my 2011 Mini Cooper S Hardtop was covered. We're at 99K miles, and it rattles significantly when it's cold. Not so much when warmed up.
