I was filling up for gas with the engine/lights off, obviously, when I noticed that the right tail light was on. It was on like you are stepping on the brake. I checked the bulbs and they seem to be just fine. I noticed that the right rear turn signal didn't work and I would get the fast flashing turn signal light on the dash to show me that the bulb could be out.
I got home and fiddled with it some more with the lights on. Took them out then put them back in. Switched them out with new ones and it was the same. Now when I put the old ones back in the brake lights turned off. Tested the turn signals and they where magically back to normal. Time to test the brake lights.
The rear light stays on like it should but the brake lights on the broken side don't turn on when I step on the brake. It might be hard to tell from the picture but the right bottom light is only half illuminated as if you weren't stepping on the brake while the other side is 2X illuminated like it should be under braking.
I have general knowledge about how various mods and standard car parts work, but when it comes to electrical stuff, I'm not the brightest. Have you guys run into something like this before and know what's going on? What should I check/replace? If it helps, I was up in Tahoe when the snow storm hit, so that could have shorted out something but I don't know what.
I'm taking it to my private mechanic to check it out (since the warranty is out), but he's not a MINI expert. Hopefully you guys can push us in the right direction if he can't come up with any answers.

From the picture I would assume you are referring to the top bulb on the RH side being out.
The top bulbs in an 04 are for fog lights. I do not have the proper switch panel in my 04 so those bulbs never light.
There is a kit to turn them into brake lights so if you purchased used it is possible that your car has this kit and it has malfunctioned.
Also (on mine) if the car is off and the turn signal switch is moved L or R the parking lights will light on that side. Some sort of Euro safety feature capability.
