What is this?

On the driver's side right by the rear wheel is a black rubber piece that is out of place. I noticed that it's rubbing against the wheel, is this a problem? On the other side the rubber piece is in it's original position.

What is this piece of rubber?

Here's how the other one looks....

Thanks for the help, looking forward to some responses...

Looks like a dust boot out of place.

That is the stone chip guard. Weird thing is the one on my '04 is in exactly the same position. I think it may be fastened with the lower shock mount bolt but I can't find out for over a week.
If you decide to pursue a fix yourself or if the dealer fixes it I'd appreciate an update. Thanks.

Yesterday I tried to bend it into place but it's difficult... I did get it out of the way of the wheel, but I'll call the dealer on Monday and get an appointment.
