Mini Cooper shooting out Tranny fluid, dealer states part is not available in the US

I have a 2004 Cooper with 24K miles on it. At high RPM's it is spilling out transmission fluid from the top, at low rpm it will not do it. Turns out there is some line that goes into the transmission from the top and the valve/gasket for it is missing and that is why it is shooting out the fluid. The dealer states this part is not available in the US and does not show him to be able to buy it. He claims that he is going to get in touch with the Mini warranty company and try to swap out the transmission because this part cannot be located here in the US, this car has a "rebuilt" title because it was involved in a fender bender back in 2005 so I don't think he knows that this car IS NOT under factory warranty.... I am lost on what to do because I think it is a safe bet he will not be able to just swap out transmissions because the replacement part is not sold in the US

First thing I'd do is call Mini USA and ask them if the car has a warranty. 1-800-ASK-MINI.
If the answer is yes, then call the dealer and clarify with them that the car has a warranty and this isn't going to cost you anything.
If that all works out, then let them do whatever they want... it's on thier dime.

If it is not under warranty I would start looking for a salvage yard that has that part, then have someone install it (Mini dealer or other).

Check on that warranty issue asap. Thats the key to everything here.

thanks.... i will call mini and give them the vin and ask about the warranty, pretty sure its void but I'll ask

Factory warranty is 4 years, so a 2004 model should still be covered.

Well here is the update.... the tranny was changed (no questions asked) and it cost me $0 from my pocket.... I was shocked and was highly doubtful especially when the car had a rebuilt title.

It's nice when things work out this way. MINI came through for me w/ a barely post-warranty clutch replacement. Technically, they didn't have to do it, but they did!!

Duct Tape and Baling Wire. Never leave home without it.
