Okay, this is in reference to this thread :

My SA, David Mills, called me the next day after dropping the car off telling me when they disassembled the clutch, they noticed heat spots on the disk which means that this car has been abused so they are not covering it under warranty. I had two options then : 1) pay the $861 for the labor of removing the clutch and putting it back or 2) pay ~$3k for a new clutch installed with labor included. I explained to Dave that I have been driving stick for 7 years now. My first car was a 90 Honda Accord w/JDM H22A motor (200hp). My second car was a 95 M3. My M was tracked two times and ever since owning that car, I have never seen smoke come out of my hood like that. Also, this car is a daily driver and I don't race it much since I am older now and have never seen a track day with this car. He says okay he will talk to the shop foreman and give me a call back.
Next day came around, he calls me and tells me that the dealership will cover it as a maintenance item. He doesn't exactly know what happened, it could be a manufacture defect or whatnot, but it is covered! Needless to say, I was jumping with joy after hearing him say that.
Today, he called me and says that the car is done and it's ready for pickup.
All in all, this is the second experience with Assael and it has been great. I must say it has to do something with SA cuz Dave is the best!! Thanks Dave if you see this!
P.S. My car has 17k miles so it may or may not have something to do with their conclusion that the clutch and/or components has a manufacture defect.

the entire "clutch has been abused" line at dealerships is BS!!! it is fairly well documented there have been ongoing flywheel problems with these cars, and the clutch is a bit of a weak link. clutch failure at less than 75k, in something that has not seen a dragstrip (drag racing IS HARD ON THE CLUTCH) is pretty unheard of in modern cars, EXCEPT BMW products.
M5 and M3 pressure plate failures are common, as are MINI clutch issues. anyone who is greeted with the abuse line in a dealer drive needs to start calling MINIUSA immediately!!
