R56 Bad Thermostat?

Bad Thermostat?
Greetings,
I've gotten a problem today that is very similar to what I had about a year ago around this time. R56 MCS takes a while to start heating up, its freezing my ankles for about 30 minutes before it gets working again. When this happened last time it happened for a while before the CEL kicked on, I just got the CEL today with the same symptoms. Dealer replaced the thermostat under warranty before, but at 56k miles I'd have to eat the cost (if it truly is the thermostat) Also after the short drive I did (while freezing my ankles) the Fan kicked on after turning of the car (its 17F outside I don't think it would overheat on a 5 minute drive)
So I'm wondering.. Could it be the thermostat again? Do you think I could get the dealer to do something about it (seeing as this was a previous issue?)

Thanks! That should probably cover the labor as well no? If not I'm guessing it won't be too bad... Although they do like to take their sweet time...
